In a decision by the supreme court the judgment of the circuit court is affirmed in the case of E. L. Asbill and others, trustees of school district No. 15, against A. D. Martin, superintendent of education of Lexington county; E. L. Wingard, county treasurer, and Miss Fannie L. Johnson, a school teacher. The opinion is by Associate Justice Woods. The case grew out of a joint resolution passed by the general assembly in reference to the pay of |315 salary to Miss Johnson for services rendered in 1906-'07. The circuit court held that the resolution violated section 6, article 2, of the constitution of the State and this is affirmed by the supreme court. The resolution was passed at the last session of the legislature and required the superintendent of education of Lexington county to draw a warrant for Miss Fannie L. Johnson for ?315 to pay for teaching in Leesville district No. 15 for the years 1906 and 1907 and also the county treasurer was authorized to pay said warrant out of funds which he had in hands as treasurer to the credit of Leesville district. The trustees of the district brought action to enjoin the superintendent from drawing the warrant and the treasurer from paying it, alleging the resolution to be unconstitutional. The defendants demurred to complaint on the ground th it it cid not state facts sufficient t constitut * an action.
