Great Excitement Broke Forth in Courtroom
When Startling Discovery
Was Made.
New York, Jan. 9.?The greatest
excitement broke forth in Part 1, of
the court of general sessions, where a
civil suit was being heart today, when
it was discovered that Moses Olenick,
juror No. 2, who was apparentlyasleep
in his chair in the jury box,
was dead.
The clerk of the court was calling
the roll of the jurors, but when he
reached Olenick's name there was no
response. He called a second and a
third time, but still there wa9 no response.

, Nearest the juror was Thomas
, "Moore, an agent of the Gerry society,
and Moore leaned forward and touched
the apparently sleeping juror on
the shoulder.
Moore saw in a moment* that the
juror was dead. Dr. Frank McGuire,
the Tombs prison physician, was hurriedly
sent for, but he said the man
had been dead several minutes. He
had been stricken \yith heart failure.
Judges to Sit En Sane.
In order to have the State courts

Judge Brawley of the United States
court, an en banc sitting of the circuit
and supreme court justices has
been called to sit in Columbia on Jan'
nary 16th to consider the constitutional
questions that might arise.

Jflxn. Martin Livingston at their home
at Goldsboro in the upper part of the
"jpounty last night at 9 o'clock by twq
negro farm hands on the place.
Mr. Livingston was struck on the .
head with a hatchet and his wife's
throat was cut. Both were danger- ;
ously hurt and at last accounts were <
not expected to live. The dastardly
deed was committed, it is supposed,
for the purpose of robbery.

been captured and shot to death.

Terrible Wreck en Southern.
A terrible wreck occurred on the
Southern Railway near Atlanta last (
Wednesday when an excursion train !
from the North jumped the track,
causing several coaches to turn over,
killing three men outright and wounding
probably a hundred more.
The cries and moans of the injured ;
and dieing were heartrending. The
cause of the wreck is unknown. ' <

miles from Johnston, lost his eye a
few days ago in a most peculiar manner.
He was mounting his mule when
the animal jumped and the buckle on
the bridle struck Mr. Clarke in the
