Georgia Prohibition Law as
Passed By House.
Atlanta, Ga.?As amended and passed
by the house last week the Hardeman-Covington-Neel
prohibition bill
reads as follows:
"An act to prohibit the manufacture,
sale, barter, giving away to induce
trade, or keeping or furnishing
at public places, or keeping on hand
at places of business of any alcoholic,
spirituous, malt or intoxicating liquors
or intoxicating bitters, or other
drinks, which if drunk to excess will
produce intoxication; to accept sale9
of alcohol in certain cases, upon certain
conditions; to provide certain
rules of evidence in connection with
the enforcement hereof; to prescribe
penalties, and for other purposes.
Section 1. From and after the first
day of January next, after the passage
of this act, it shall not be lawful
for any person within the limits of
this State to sell or barter for consideration,
either directly or indirectly,
or give away to induce trade at any
place of business, or keep or furnish
at any other places, or manufacture
or keep on hand at their place of business
any alcoholic, spirituous, malt
or intoxicating liquors, or intoxicating
bitters, or other drinks, which, if
drunk to excess, will produce intoxication,
and any person so offending
shall be guilty of a misdemeanor, and
shall be punished a9 prescribed in
section 1039 of the penal code of Georgia.
Nor shall it be lawful in the lim
its of said State for intoxicating I
liquors to be sold in dispensaries, and I
the sale of intoxicating liquors in said
State shall be prohibted to private
persons and to the State, its officers
and agents.
The Doctor's Amendment."
"Provided, that licensed druggists
may sell and furnish pure alcohol, for
medical purposes only, upon written
prescription of a regular practicing
physician of this State, in the manner
herein prescribed, to wit: Before any
physician shall issue any such prescription
he shall make an actual examination
of the person for whom the
prescription is granted. The prescription
shall be substantially in the following
form: 'Georgia
county. I, , a regular
practicing physician, under the laws
of said State, do hereby prescribe for
the use of , a patient in
my charge, whom I have personally
examined of pure alcohol,and
do certify in my opinion that the
same is necessary in the alleviation or
cure of illness from which said patient
is suffering. This (date.) (Signed by
the physician.)' No prescription
shall be filled hereunder except upon

issued, or upon the following day.
Within te& days after the same is fill-,
ed by the druggist he shall file said
prescription for record with the ordinary
of the county in which filled,
who shall cause the same to be recorded
in his office, and a certain
copy of the same, or the original prescription
showing it has been recorded,
shall be primary evidence in any
court in this State. The record containing
such prescriptions shall be
open to public inspection. A recording
fee of 5 cents for each prescription
so recorded shall be paid by such
druggist to the ordinary. Upon any
prosecution under this act the burden
of proving the defense that the sale
was of pure alcohol under prescription
as herein provided for, shall be upon
the defendant. Provided, further, no
druggist who is also a practicing physician
shall fill his own prescriptions
hereunder, nor shall they be filled at
any drug store in which said physician
is financially interested, and no
prescription shall be refilled; nor shall
more than one pint be furnished on
any one prescription. The delivery
of the alcohol under such prescription
shall be made only directly to the
person for whom such prescription is
issued or to the physician; or in case

for him; or in case of a married woman,
to her husband for her.
Provision for Wholesalers.
Provided, further, That nothing in
this act shall be so construed as to
prevent wholesale druggists from selling
or furnishing alcohol in wholesale
quantities to regular licensed retail
druggists or to public or charity hospitals,
or to medical or pharmaceutical
colleges.
"Be it further provided, That all
wholesale druggists shall be required
to keep a complete record of all their
sales of alcohol, which record shall at
all times be open for inspection to
the regular authorities of such counties
or cities in which such ^wholesale
stores are located.
Section2.?Any person, firm or cor
J poration who shall violate this act in j
any respect shall be guilty of a misdemeanor;
any physician who shall issue
a prescription hereunder containing
any false statement shall be guilty of
a misdemeanor; any druggist who
shall fill any prescription for alcohol
in anywise other than herein allowed,
' or shall fail to file a prescription filled
by him hereunder with the ordinary
within the time prescribed, shall be
guilty of a misdemeaner; any person
I who shall obtain alcohol for another
in accordance with the terms hereof,
and who shall convert same to any
other use, shall be guilty of a misdemeanor.
Section 3. Nothing in this act shall
prohibit the sale bjr licensed druggists
of wood or denatured alcohol for art,
scientific or mechanical purposes, or
grain alcohol for bacteriologists, who
are actually engaged in that class of
work for scientific purposes only.
Section 4. All laws and parts of
laws in conflict with this act to be,
and the same are hereby repealed."

An instance of the complications
divorces obtained by rich residents of
Newport, was related by Rev. Floyd
W Tnmkms. rpotnr of Holv Trinitv
Episcopal church, in his sermon to
the First Regiment, National Guard
of Pennsylvania, on Sunday afternoon.
Dr. Tomkins vouched for the
truth of the story and said the incident
ocourred at Newport last summer.
Two boys were at play, when
one pointed to a man passing in an
automobile. "That's my new papa,"
exclaimed one of the boys; "I think
I'm going to like him." "He ain't so
much," remarked the other child.
"How do you know?" indignantly demanded
the first boy. "I guess I
ought to." was the reply, "He used to
be my papa."
Beat Ser Daughter To Death.
Little Rock, Ark., July 28.?After
quarreling with her husband, Mrs.
Wm. Blackburn of Montgomery county
waited until Blackburn left the
house today and then attacked: her!2r
year-old stepdaughter., beating her to
death with a broomstick.
The child'8 back was broken and
her skull fractured. Sentiment is high
against the woman. She will be taken
to Hot Springs for safe keeping.

Election Was Illegal.
Columbia, Aug. 1.?The state board
of canvassers today unanimously decided
the appeal in the Kershaw dispensary
election case in favor of the
dispensary finding that the election
was illegal on account of irregularities.
This reverses the finding of the
county board, which found that prohibition
carried by 84 votes and it
keeps the dispensaries open. The
prohibitionists will take the case to
the supreme court on writ of certiorari.

Old Orchard, Me., July 31.?During
the second day's session today of the
Maine Temperance society a telegram
was received conveying the announcement
of the passage by the Georgia
legislature of a prohibition liquor law.
A prayer and praise sendee which
was in progress at the time was
changed into a meeting of general
congratulation. The audience received
the announcement with tears
and hand-clapping, while the leaders
on the platform clasped hands enthusiastically.
During the session yesterday a special
prayer was offered for the passage
of the Georgia law. Following the
receipt of the news today congratulatory
telegrams were sent to Gcv.
Smith of Georgia and to Mrs. Armour,
president or tne ueorgia woman's
Christian Temperance Union.

Must Accept New Bate.
Raleigh, N. C., July 31.?The State
corporation commission today decided
that the Louisville & Nashville
railroad must accept the 2)^ cent passenger
rate. Gov. Glenn immediately
notified it of the commission's ruling.
A telegram was received frcm
the Carolina & Northwestern railroad,
which intimates that the road will
accept the new passenger rate.
