I Tn? Lexington Dispatcb! Wednesday, December 9, 1903. Town Ordinances. Ba it ordained by the Town Council of the Town of Lexiogton, (3. C.) in oanoil assembled and by the authority of the same: TOWN COUNCIL See. 1. That the Mayor and Al dermen shall constitute the Town Council of the Town of Lexington, and as such they shall pass all needful rules, regulations and ordinances for the safety and good conduct of the government of the town: and they shall be obeyed and respected Accordingly. DUTIES OF THE MAYOR. Sec 2 That the Mayor shall be the executive bead of the town, and as such it shall bo his duty to b* * vigilant aod active at all times io looking after the enforcement of all laws and ordinances of the Town; and he shall be impowered to enforce all of bis lawful orders to any subordinate officers; and in case of riot, tumult or breech of the peace, or in ease of a probability of snob, he is authorized to call to bis assistance, for the preservation of order, or putting down of any disturbance, any of the inhabitants of said Town, and in case any one shall fail or refuse to lend such assistance when so called spon they shall be fined not more than fifty (50) dollars, or be im prisoned not n ere than twenty five (25) days. power of the mayor to try offenders Sec 3 Tbat the Mayor shall have power to speedily try all offenders against any ordinance of the Towd, 1 and impose such doe or imprisonment as in his judgment is proper and allowed by the ordinances of the Town, in a summary manner without a jury, unless a jury is demanded by the accused, and unless the accused oKaII on fop inhn a. onnd find sufficient recognizance, to be approved by the aaid Mayor, to appear for trial within foar days after his arrest or at such other time as may be agreed upon, in \ such ease the trial shall be deferred ontil that time. If any defendant consider himself or herself aggrieved by the decision of the Mayor, they or any of them shall have the right to appeal from such decision to the Town Council, provided notice of such appeal is given within twenty-four hours after sentence has been passed, and a good and sufficient bond is given, to b" approved by the Mayor, to appear and defend before the said Council at a time to be specified, and to abide the decision of the Town Council. At suoh appeals the Mayor shall preside and the Aldermen shall sit as a jury to try the facts; and they may reverse, confirm or modity any or all of the rulings or conclusions of the Mayor made or reached on the first trial of the case. POWER TO CALL THE COUNCIL TOGETHER IN CASE OF RIOT OR TUMULT. Sec. 4. That in case of tumult, riot or breach of the peace, or the appearance or probability of same, in said Town, the Mayor shall be impowered to immediately summon the Council together, to take such measures as to them ?shall appear wise and proper at the time, and if any of the Aldermen shall fail or refuse to obey the call or any lawful orders of the Mayor in such case each one so offending shall be fined not more than twenty-five (25) dollars or be imprisontd not mor6 than ten (10) days. MAYOR?POLICE. Sec, 5. That the Mayor shall have power and control over the police force of the Town, to direct and instruct them in the discharge of their duties; and if any policeman shall fail or refuse to obey any lawful order, given at any time by the proper authority, be shall be fined not more than forty (40) dollars or be imprisoned not more than twenty-one (21) days.
