The Lexington Dispatch. Wednesday, September 9, 1903. Synopsis of the Jury law. Sec. 1. Be it enacted by the General Assembly of the State of South Carolina: That the County Auditor, the County Treasurer and the Clerk of the Court of Common Pleas of each County in this State shall perform the duties hereinafter set forth. Sec. 3. That of the list so prepared, the County Auditor, County Treasurer and Clerk of the Court of Common Pleas, shall cause the names to be written, each one on a separate paper or ballot, so as to resemble <~>fVior no mneli ns -nnnflihlA and ?*-- CHVU WUVft ? ?? wmvm ^ ?? ? so folded that the name written thereon shall not be visible on the outside, and shall place them, with the said list, in a strong and substantial box, without appertnres or openings when closed (to be known sb the "Jury Box") to be furnished to them by the County Supervisor of their County for that purpose, and of Buch size and shape as that, when such separate papers or ballots shall have been folded and placed therein as above required, tbey may be easily shaken up and about and well mixed therein, and it shall be the duty of the Clerk of the Court to keep said jury box in his custody. The said jury box shall be kept securely locked with three separate and strong ' locks, each lock being different and distinct from ?he other two and requiring one key peculiar to itself in [ order to be unlocked and the key to * r i one of said three locks shall be kept by the County Auditor himself, the 1 key to another of said three locks by the County Treasurer himself, and 1 the key to the third of said three 1 locks by tbe Clerk of tbo Court of Common Pleas himself, so that no two of them shall keep a Bimilar key J or similar keys to the same lock, ttnd so that all three of them must be 1 present together at the same time 1 and place in order to lock or unlock 1 and open the said jury box. At the 1 same time they shall place in a special 1 , apartment in the said jury box >' (which special apartment shall be known as "the tales box") the names ' / of not less than one hundred nor more than four hundred of such of the persons whose names appear on Baid list as reside Within five miles of the Court House, from which tales box shall be drawn jurors to supply -deficiencies arising from any cause or emergency during the sitting of-the Court. Tbe names of \ persons placed in said tales box shall be also placed in the said jury box. Sec. 5. That not less than ten nor more than twenty days before fchft firflt dftv of each week of anv regular or special term of the Circuit Courts the' said the County \ Auditor, the County Treasurer and the Clerk of the Court of Common Pleas shall proceed in like manner to draw thirty-six petit jurors, to serve for such week only: Provided, That whenever a jury shall be charged with a case, such jury shall not be discharged by reason of anything in this section contained until a verdict shall be found or a mistrial ordered in 8nch case. Immediately after such petit jurors are drawn the Clerk v of the Court of Common Pleas shall issue his writ of venire facias for , such petit jurors, requiring their attendance on the first day of the n week for which they have been drawn; and the said writ of venire facias shall be forthwith delivered to { the Sheriff of the County: Provided, That in case any term of Court is to be held within less than twenty days after the approval of this Act, such petit jurors may, nevertheless, be drawn for such term of Court. Sec. 6. That the said drawing shall be made openly and publicly in the office of the Clerk of the Court of Common Pleas, and the County Auditor, the County Treasurer and the Clerk of the Court of CommoD Pleas shall give ten days' notice of each of said drawings by posting in a conspicuous place on the court house door, or by advertisment in a county newspaper, a notice of the place, day and hour of such drawing. Sec. 7. That all jurors shall be selected by drawing ballots from the the said jury box, an3, subject to the exception herein before contained, the persons whose names are on the ballots so drawn shall be returned to serve as jurors. < Sec. 11. That no more than thirtysix persons, to serve as petit jurors, , shall be drawn and eummoned to 1 attend at one and the same time at , any Court, unless the Court shall so order. Passenger train No 15, north-bound, on the South Carolina and Georgia Extension Railroad, formerly the Three C.'s, now operated by the Southern Railway, went through a trestle fifty feet high over Fishing Creek, three miles east of Yorkville.. about 1130 o'clock to-day, killing eix men and injuring twenty-five, of whom five will likely die. Three of the Latter are negro passengers. The train consisted of an engine and three cars. It left Rock Hill about 11 o'clock with about forty passengers on board. Cotton has commenced to open, and the cotton crop will not be more than a half an one this year. Corn crops are right good. The protracted meetings are over, and the farmers are trying to gather their crops. The charming Miss Ollie Geiger is visiting Mr. O. B. Riley's family in OraDgeburg county, and one old bachelor seems very sad. You can guess why?beer ise she is gone. Mrs. Magdeline King and her handsome little daughter, Hustiline, of George's Station, have been visiting the family of Mr. H C. Rucker, much to the delight of the home folks. Misses Maude andSallie Bookman, two of Columbia's fairest daughters, ire visiting the family of Mr. J. Kinser Davis. Mr. Hampton Rucker and family, Miss Mattie Perkins and Mrs. Emma Dutton, of Columbia, are visiting at Mr. and Mrs. J. A. Kaigler'e. Mr. B. H. Kaigler is at home for a ew day's rest. Hope he will soon eel well again. Messrs. G. F. and L. E. Kaigler vill leave in a few days for Clemson jollege. Wish for these boys much iucc668 with their studies. The charming Miss Lula Strock of Cameron, has been visiting Mrs. H. ?. Franck and Mrs. J. A. Kaigler, of Sakersville, much to the delight of ler many friends. Mr. Stuart Mack, of Alabama, is risiting his many friends in old South Carolina. They are all glad to see >ld Stuart as he is a jolly fellow. Miss Linnie Spradley, with her wo pretty little girls, of Irmo, has jeen visiting her father and mother, Mr. and Mrs. Henry Griffin. Miss Gertrude East, of Irmo, has )een spending sometime with Miss Liizzie Taylor, and took in the Beuah meeting. Miss Gertrude, we are ilways glad to see you. Mr. James J. Wolfe is home for a !ew week much to the delight of jverybody. He will return North in i few days to resume his studies. Manila, Sept. 3 ?The Jolio conrtabulary has come into conflict with i body ot insurgents in tne province )f Cavite, near Laguna de Bay, and lilled twenty during a sharp engagenent. The constabulary had one nan killed. Reinforcements have eft Manila for the scene of disturbance to subdue the insurgents, who lave taken a strong position in the nountains. Sour Stomach.
