The report sent out from MontgomIery to the effects that judge Jones advised the federal jury that persons convicted of misdemeanors, whose sureties confe-std judgement for them could not restrain or work them without violating th9 statutes agatDst peonage, is entirely incorrect He advised directly the reverse aDd held that such persons haviug been duly convicted of crime their involuntary servitude was lawful if the sureties complied with the state law by having the contract made in open court with writteu approval of the judge. The law which he advised the jury 18 COQStit'Jt OQBi '8 l(je renters ui laborers' law of 1901, which punishes tha laborer or renter if he gets work elsewhere after breaking his contract without informing hia new employer, and also punishes any person viho employs the l*bor or reDter after knowledge that be has left his first employer. The later statute was held to amount to imprisonment for debt, class legislation, denial of the tqual protection of law to croppers and la bors and also violating United States statutes against peonage by coercing personal service for payment of a deb*. Croft, E.-q . leading counsel for James H Till j mac, announced that application for a cbauge of venue will be made on the grounds that Tillman cannot get ? C7 ? a fair trial in Richland county. Affidavits to this end bave been served on Solicitor Thurmond and *tbe court will decide in what county the case will be tried in the event the motion to chaDge is granted. The R'chland court convenes on tbe fourth Wednee\ day of this month, with Judge Townsend presiding. A Guignard were appointed a committee to have this work in charge. The committee is dow at work on the plans for a new buildiDg, and it i* expected that the work of tearing dowQ the old one will commence shortly. Njt only will a new building be erected, but many improvements wili be made iu the large building and in the stalls for tbe stock. The grounds will also be graded and several chaDgea made id the plans. of this has already been done and the rest will be finished in time for the next fair. The famous Amos O.ven cherry j tree case, about which so much has j been heard, came up agaiD iu the United S:aie9 district court at Caarlotte last week. It will be re- j membered that when several con- j victions were secured in the case, j about one year ago, Judge Boyd gave the defendants the option of payiDg back the money many women had been induced to put into the swindle or pay fines and serve sentences in jail. Most of the defendants have made arrangements which are satisfactory to the court, but Dr. Frank Bright was not amoDg the Dumber. He, with others, was under bond to appear at the present term of court, and when the case was called Judge Boyd sentenced Dr. Bright to serve a sentence of six months in jail and pay a fine of $1U0 ?Fort Mill Times. Attorney General Knox presented a carefully prepared opinion on the subject strongly affirming the right of the government to disregard the injunction granted yesterday in the Virginia Court which foibids the resumption of the work on the Galveston pending a settlement of the claim of the sub contractors who have not been paid for the material furnished.
