The Lexington Dispatch. Wednesday, June 17, 1903. Hunting?General Provisions. Sec. 422 (1GS9 ) If any perBOD, at any time whatsoever, shall hunt or range on any lands whatsoever without the consent of the proprietor, every such person so offending shall forfeit and pay the sum of ten dollars for every such offense. Sec. 423. (1690.) Any person or * i* i ? *11. i* persons wno snail nuni wua are iij the night time, for every such cffense shall foifeit and pay a sum not ex. ceeding ten dollars, and for every deer so killed, a sum not exceeding twenty-five dollars, and for every horse or head of neat cattle, or other stock of any kind, a sum not exceeding fifty dollars. Sec. 224. (1691.) All of the penalties and forfeitures mentioned in the preceding Section shall and may be recovered before any Trial Justice in the county where any of the said offenses shall be committed, and when received shall be divided and paid one-half to and for the use of the poor of tfye county where the offense shall be committed and the other half to the person who will inform for the same; and the oath of one - m # credible witness, or the coniession 01 the party accused, shall be allowed as sufficient evidence to convict tbe offender by every Trial Justice before whom information shall be made of any of tbe offenses aforesaid; Provided, That where the owners of any 1 ]amis shall prosecute for any unlawful hunting and ranging on his or her lands, the oath of: such owner shall be sufficient evidence to convict the offender; but in that case the whole penalty shall go to the use of the poor of the county. Sec. 425. (1692.) In case any person or persons eo convicted shull re fuse or neglect to pay such fine, then it shall and may be lawful, and the Trial Justice before whom he is convicted is hereby required, to commit such person or persons to the common jail in the county where the offender or offenders shall have committed the said orime, there to remain without bail, for a term not exceeding three months for unlawfully hunting with fire in the night time, and for a term not exceeding two months for violations of Section 422 of this chapter. In addition to the above penalties, any person or persons who shall hereafter hunt with fire in the night time, kill any horse or neat cattle; or other stock of any kind, the property of another person, shall be liable to a civil action by the person aggrieved. IN8ECTIVOROUS AND OTHER BIRDS. Sec. 426. (1695.) It shall not be lawful for anv oerson in this State to ? A. wantonly ehoot, or entrap for the purpose of killing, or in any other manner destroy, any bird whose principal food is insects, or take or destroy the eggs or young of any of the species or varieties of birds that are protected by the provisions of tbis SectioD, comprising all the species and varieties of birds represented by the several families of bate, whippoorwills, fly-catchers, thrashers, warblers, fiDches, larks, orioles, nuthatchere, wood-peckers, humming birds, blue-birds, and all other species and varieties of land birds, whether great or small, of every description, regarded as harmless in their habits, and whose flesh is unfit for food, including the turkey buzzard, bufc*excluding the jackdaw, the crow, the crow black-bird, the eagle, and all hawks and owls which prey upon other birds; and any person violating the provisions cf this Section shall on conviction thereof forfeit and pay a fine cf ten dollars or be imprisoned not less than ten days, which fine, if imposed, shall go onehalf to the informer and the other half thereof to the use of the county 1U n Ulk/U \IU\J uuv/uuu .. Provided, Tbafc no person shall b? prevented from protecting any crop of fruit or grain on his own lands from the depredations of any birds herein intended to be protected. Sec. 427. (1698.) No person or persons shall at any time or place within this State take, kill, sell, expose for 6ale, export beyond the limits of th8 State, or cause to be taken, killed, sold, exposed for sale or exported beyond the limits of tie State any mocking bird, nonpareil, swallow, bee bird, red-bird, woodpecker, thrush or wren under a penalty of five dollars for each bird so taken, killed, sold, exposed for sale or exported beyond the limits of the State; and it shall be lawful for any person to take or destroy and net, traps or snares used for taking such birds wheresoever found set for such purpose: Provided, That nothing herein contained shall prohibit any person from taking and keeping any bird of song or plumage for his own i * pleasure or amusement, ana not ior sale, traffic or gain. Sec. 4*28 (1697.) No person or persons shall destroy or rob the nests of any of the said birds under a penalty of ten dollars for each offense. Sec. 4*29. [1698] The penalties incurred for violation of the provisions of the preceding Sections shall be recovered before any Trial Justice in the county where such offense shall be committed and shall be paid one half to the informer and the other half to the County Treasurer for the use of the county. Sec. 430 [1699 ] Iq case of failure by any. person or persons to pay any sum recovered under the provisions of Sections 426, 427 and 428, the said person or persons shall be committed to the jail of the county for a period not less than five days, and at the rate of odo day for every dollar of the sum so recovered and not paid when the amount recovered exceeds five dollars. Sec. 431 It shail not be lawful for aDy person, except upon bis own land?, or upon the lands of another with the consent of the owner thereof, to net or trap a partridge. Any person violating this Section shall be guilty of a misdemeanor, and ^upon conviction shall be puuished by a fine of not exceeding thirty dollars or by imprisonment in the county jail for a term not exceeding thirty days. Sec. 432. [1694 ] It shall not be lawful for any person in this State, between the first day of April and the first day of November, in any year hereafter, to catch, kill, or injure or to pursue with such intent, or sell or expose for sale, any wild turkey, partridge, quail, woodcock or pheasant; or between the first day of March and tbe firBt day of August, any dove; or at any time during th9 year to catch, kill or injure, or to pursue with such intent, by fire-light, any of the birds named in this SectioD. And any person so doing shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not more than twenty dollars or be imprisoned not more than thirty days. Sec. 433 [1700 ] Nothing herein shall apply to any person who shall kill or take any of the said birds for the purpose of studying its habits or history, or having the same stuffed and set up as a specimen, or to any person who shall kill on his premises any of the said birds in the act of destroying fruit or grain crops. Sold by all druggists. Alcoholic Patients. The Iowa Legislature passed a law last year permitting the confinement of confirmed drunkards in lunatic asylums. It made little stir, but within eight months 300 alcoholic patients were under restraint and treatment. An Iowa dispatch says that iuebriates continue to flow into the State asylumns at the rate of about fifty a month and that an Iowa court has just ruled that their constitutional rights are not violated by their detention. Some of the inebriates don't like to be sent up, but the treatment they get seems to be humane and salutary. Their liquor is stopped and they have to work on farms and are encouraged to imnrnvA f.hpir hfthits.
