C. Myers, was charged with th
murder of his brotlier-in-law
Samuel W. James, on the 2Gth_q
last Juno, near Scranton, in thi
county.
Both the defendant and th
dead man come from good, sub
stantiul families, and it was a cas
where the stamina of a jury wa
tested.
The facts of the case, as gatb
ered briefly from the testimony
are about as follows: Bad bloo
had existed between Myers am
his brother-inlaw, James, fo
eight or ten years, from whic
several pronounced disagreement
had arisen and had resulted one
in a personal encounter betwee
the two men. The cause of th
late unfortunate tragedy was
dispute oyer a line fence separs
ting their respective places. Th
dispute continued to the point c
the fence being toin down b

himself, when it was rebuilt o
mended by the dead man, James
The evening before the shootin*
both men met at the dispute*
fence, where it had been tor
down by Myers, and then an

he (Myers) would kill him. My

Next morning Myers noticed tha
a few rails had been put back o
the fence, and he, first possessin(
his gun, went over to James
house. The latter was not u
home and while returning to hi
own home Myers saw James bac
of the letter's house mending
fence, not the one in dispute
Myers approached James an
hailed him. Just as James wa
lifting up a rail Myers shot him
hitting him in the arm, not disa
bling him, however. No. 4: she
were used. While Myers was al
tempting to reload, James rushe
upon Myers and the two men col
la rod each other. Then Myer
hit James on the head with hi
gun, which was broken by th
lick. Using the barrel, Myer
hit James on the head, inttictinj
four mortal wounds. James
head was severely crushed, th
brains oozing out. Myers thoi
left the body in the field and can
to Kingstree and surrendered.
Judge Gage's charge to th
jury was clear and impartial. 1
is said by many listonors that i
was the ablest charge that hn
been heard from the bench at tl.i

noon at 5 o'clock, and an all-per
vading silence fell over the courl
room as the clork announced th
verdict: "Guilty, recoinmende
to the mercy of tho court." Th

It is historically true that not a
single white man has been hung
here sinco the war, but the mercy
of the court only saved Myers.
