Dial Continues Fight on Joe Tolbert. Laurens, Oct. 19.-Senator N. B. Dial was this afternoon advised of the recess appointment of Joseph W. Tolbert as United States marshal for the Western district of South . - Carolina. Senator Dial has opposed Tolbert's nomination from the first and he indicated that he was not through with the protest. V The senator wired District Judge Watkins protesting the qualifying of Tolbert, citing the fact that the ap pointee has been convicted in the United States courts of criminal acts and in all probability he is dis qualified to take the oath and hold office under the constitution! The senator also wired Gen. M. L. Bon ham to take such steps as necessary to prevent Tolbert from holding this important* post. He pointed out to General Bonham that unless Tolbert has been pardoned, he can not quali fy for the office and the senator says that he does not know of any such pardon having been granted. The conviction of Tolbert referred to was for alleged embezzlement and lar ceny after trust according to the rec ords, says the senator. Sen. Dial says that when Tolbert's nomination was sent to the senate he objected to confirmation whereupon the case was referred to a subcommittee of three members of the judiciary commit tee. Charges were filed and the com mittee was urged to have Tolbert come before it for a hearing of the case, as it was the intention of the senator to cross-examine him before the committee. A demand for a com mittee proceeding was made several times, but Mr. Tolbert did not ap pear, although this was urged by the senator. Considering these grave charges, says Senator Dial, which were un answered and unanswerable, he con siders it an outrage to the decent people of South Carolina for the Re publican administration to try to force a man of such character on this district and state. Continuing, Senator Dial said that ? if Judge Watkins allows Tolbert to ; qualify, possibly all his official acts i ' will be illegal. In the event, however, that Tolbert is permitted to qualify, ; the senator says he will do all in his power to have the nomination reject- i ed when it comes ap in the senate for : confirmation. . Washington, Oct. 19.-Joseph W. Tolbert, whose nomination as mar- , Greenville, Oct. 19.-Joseph War ren Tolbert of Greenwood county, Republican national committeeman, has been appointed United States marshal for the Western district of South Carolina and will assume the duties of that office as soon as he files the usual bond. He received a recess appointment from President Harding and will hold office for an undetermined pe riod, pending the action of the United States senate upon his nom ination by the President, which re mains unconfirmed, due to the oppo sition of Senator N. B. Dial of this state. Information of Mr. Tolbert's ap pointment was received here this morning by federal officials, his com mission having been forwarded by the United States department of justice to District Judge H. H. Wat kins. Mr. Tolbert, for many years, has Jbeen the head of the Republican party in this state and is a member of the South Carolina Republican na tional committee. When informed of the appointment of Mr. Tolbert, the incumbent, C. J. Lyon, said he had no statement to make. Dry Act to Stay, Says Pres ident Harding. Washington, Oct. 21.-The dry act is on the statute books to stay and America will never depart from it, President Harding told a delega- . tion of the Allied1 Christian Agencies here today. Some features of the law are diffi cult of enforcement, he explained, and are causing the government some concern, but the spirit of pro hibition will be carried out and there will never be a return to the open saloon or manufacture of liquor, he declared. When asked that the United States do "its full duty to the rest of the 1 world," the president reiterated the policy stated recently. He pointed out that the United States is anxious 1 and willing to help, but cannot be '. drawn into the politics of the old J world. i Notice of Election. STATE OF SOUTH CAROLINA COUNTY OF EDGEFIELD. Notice is hereby given that the General Election for State and County Officers will be held at the voting precincts prescribed by law in said county, on Tuesday, November 7, 1922, said day being Tuesday fol lowing the first Monday in Novem ber, as prescribed by the State Con stitution. The qualifications for suffrage: Managers of election require of every elector offering to vote at any election, before allowing him to vote, the production of his registration certificate and proof of the payment of all taxes, including poll tax, as sessed against him and collectible du ring the previous year. The produc tion of a certificate or o? the receipt of the officer authorized to collect such taxes, shall be conclusive proof of the payment thereof, Section 237, Code of 1912, as amended by Act No. 6, special ses sion of 1914. Section 237. There shall be three separate and distinct ballots, as fol lows: One ballot for Representatives in Congress; and ore ballot for Gov ernor, Lieutenant Governor, State officers, Circuit Solicitors, members of the House of Representatives, State Senator, county officers, and one ballot for all Constitutional amendments and special questions, each of three said boxes to be' ap propriately labelled; which ballots shall be of plain white papers and of such width and length as to con tain the names of the officer or offi cers and question or questions to be voted for or upon, clear and even cut, without ornament, designation, mutilation, symbol or mark of any kind whatsoever, except the name or names of the person or persons voted for and the office to which such per son or persons are intended to be chosen, and all special questions which name or names, office or of fices, question or questions shall be written or printed or partly written or partly printed thereon in black ink; and such ballot shall be so fold ed as to conceal the name or names, question or questions thereon, and so folded, shall be deposited in a box to be constructed, kept and disposed of as herein provided by law, and no ballot of any other description found in either of said boxes shall be counted. On all special questions the ballot cViall ?statt? tV>o ?i./??.???*?- - ~ the polls, Managers and Clerks must take and subscribe the Constitution al oath. The Chairman of the Board of Managers can administer the oath to the other members and to the Clerk; a Notary Pubac must admin ister the oath to the other members and to the Clerk; a Notary Public must administer the oath to the Chairman. The Managers elect their Chairman and Clerk. Polls at each voting place must be opened at 7 o'clock a. m. and closed at 4 o'clock p. m. except in the City of Charleston where they shall be opened at 7 a. m. and closed at -6 p. m. The Managers have the power to fill a vacancy, and if none of the Managers attend, the citizens can ap point from among the qualified vo ters, the Managers, who, after being sworn, can conduct the election. At the close of the election, the Managers and Clerks must proceed publicly to open the ballot boxes and count the ballots therein, and con tinue without adjournment until the same is completed, and make a state ment of the result for each office and sign the same. Within three days thereafter, the Chairman of the Board, must deliver to th? Commis sioners of Election the poll list, the boxes containing the ballots and written statements of the results of the election. STATE OF SOUTH CAROLINA COUNTY OF EDGEFIELD Notice is hereby given that the General Election for Representatives in Congress will be held at the vot ing precincts fixed by law in the County of Edgefield on Tuesday, No vember 7, 1922, said day being Tues day following the first Monday, as prescribed by the State Constitution. The qualifications for suffrage are as follows: Residence in State for two years, in the County one year, in the poling precinct in which the elector offers to vote, four months, and the pay ment six months before any election of any poll tax then due and payable. Provided, That ministers in charge of an organized church and teachers of public schools shall be entitled to vote after six months' residence in the State, otherwise qualified. Registration-Payment of all tax es, including poll tax, assessed and collectible during the previous year. The production of a certificate orithe receipt of the officer authorized to collect such taxes shall be conclusive proof of the payment thereof. Before the hour fixed for opening the polls Managers and Clerks must take and subscribe to the Constitu tional oath. The Chairman of the Board of Managers can administer the> oath to the other Managers and to the Clerk; a Notary Public must administer the oath, to 'Chairman. York, Oct. 20.-Charging that they drove into and smashed up his automobile Wednesday night while they were "highly intoxicated," Edi son Wallace, citizen of York, today wrote Governor Wilson G. Harvey complaining against State Constable Horace Johnson and Township Con stable Robert F. Lee. The accident occurred near here and both cal's were damaged, although the Wallace car suffered the greater damage.
