D., 1864, did, with the ob ject of suppressing tho existing rebellion, to induce ail persons to return to loy *ty, and to restore the authority of the Lnitcd States, issue proclamations offering amnes ty and pardon to certaiu portjns who hud directly, or by implication participated in the said rebellion, and as many persons who bad so engaged in said rebellion, have since the issues of i4id proclamation, fail ed or neglected to take the benefit offered thereby, under which many persons have been justly deprived of all claim and par don thereunder, by reason of their parti cipation directly, or by implication in said rebellion and continued hostility to the (iovernmeut of the United. States since the date of said proclamation, now desire, to apply for and obtain amnesty and par don. To the end and hereafter that the authority of the Government of tho Uni ted States may be restored; and that peace, order and freedom may be established, I, Andrew Johnson, President of the Uni ted States, do proclaim and decree, that I hereby grant to all persons who have directly or indirectly participated in the existing rebellion, except as hereafter ex cepted, amnesty and jiardon, with restora tion of all rights of property except as to slaves, and except in cases where legal proceedings under the laws of the United States, providing for the confiscation of property of persons engaged in rebellion have been instituted, but on tho condition nevertheless that such person shall take and subscribe the following oath or affirm ation, and thenceforward keep and main tain said oath inviolate, and which oath rfhall bo registered for permanent preser vation, and shall be of the tenor and effect following, to wit: I dd solemnly swear, or affirm, in pres ence of Almighty God, that I will hence forth faithfully support and defend the Constitution of the United States and the union of the States thereunder, and that I will henceforth faithfully support all laws and proclamations which have been made during the existing rebellion with refer ence to the emancipation of slaves. So help me God. • The following class of persons are ex cluded from tfie benefits of this proclama tion : First. All who are or who shall have been pretended civil or diplomatic officers, or otherwise foreign or domestic agents of the pretended Confederate government. Second. All who left judicial stations under tho United States to aid the rebel lion. Third. All who shall have been mili tary or naval officers ol said pretended Confederate government above the rank of Colonel in the army, or Lieutenant in tho navy. Fourth. All who left seats in the Con gress of the United States to aid in thc< rebellion. Fifth. All who resigned or tendered the resignations of their commissions in the army or navy of the United States to evade duty in resisting tho rebellion. Sixth. All who have engaged in any way in treating otherwise than lawfully as prisoners of war, persons found in the United States service ns officers, soldiers, seamen or in other capacities. Seventh. AH persons who have been or are absentees from tho United States, for tho purpose of aiding the rebellion. Eighth. All military and naval officers in the rebel service, who were educated by the Government in tho Military Academy at West I’oint or tho U. S. Naval Acad emy. Ninth. All persons who held the pre tended office of Governors of States in in surrection against the United States. Tenth. All persons who left their homes within the jurisdiction and protection of tho United States, and passed beyond the Federal military lino into the so-called Confederate States, for tho purpose of aid ing the rebellion. Eleventh. All persons who have been engaged in the destruction of the com merce of tho United States, upon the high seas, and all persons who have made raids into tho United States, from Canada, or been engaged in destroying the commerce of the United States, upon tho lakes and rivers that separates the British Provinces from tho United States. Twelfth. All persons who arc at the time when they seek to obtain the benefit hereof by taking the oath herein prescri bed are in the military, naval or civil cus tody, or arc under bonds to the civil, mil itary or naval authorities of the United States, as prisoners of war, or persons de tained for any offenses of any kind, either before or after conviction. Thirteenth. All persons who have vol untarily participated in said rebellion and the estimated value of whose taxable pro perty is over twenty thousand dollars. Fourteenth. All persons who have ta ken the oath of amnesty as prescribed in the President’s proclamation of Dec 18, A. D. 1863, or another of allegiance to tho government of the United States, since the date of said proclamation, and have not thenceforward kept and maintained the same inviolate, provided that special application may be made to the President, for pardon by any person belonging to the excepted classes, and such clemency will Be liberally extended as may be consistent with the faces af the case and the and dignity of the United States. The Secretary of State will establish rules and regulations for administering and recording said amnesty, both so as to en sure its benefits to the people and guard the Govornment against fraud. The person using or affixing the stamp or stamps, shall write thereupon the initials of his name and the date upon which the same shall be attached or used, so that the same shall not be used again, under a penalty of $50; or they may be canceled by such other method as the Commissioner of internal Revenue may pre scribe. Documents made in any foreign country, to be used in the United States, shall pay the same duty as when made here. Powers of Attorney, or other papers rela ting to applications for bounties, arrearages of pay, or pensions, require no stamp; neither do indorsement of negotiable instrument, nor any warrant of attorney accompanying a bond or note when such bond or note shall be stamped; and whenever any bond or note shall be secu red by mortgage, but one stamp duty is requi red, provided the stamp duty placed thereon is the highest rate required for said instru ment, or either of them. These eirors have become so frequent of late, as to cal. stringent measures to prevent the possibiln/ of their recurrence in tho future. All information necessary for the prompt payment of the soldier by the Paymaster, must appear on the final statements. They should show when the clothing account of the soldier was last settled, or that it never was settled; also, the amount of clothing drawn since last settlement, or date of enlistment, as the case may be. Great care should be taken to see that boun ties due to colored soldiers, who are by law en titled to the same, but who have never receiv ed any of (lie installments, especially the first which should have been paid by the Mustering Officer at the time of muster into the service, and all bounties due on whatsoever account, arc particularly noted ; also, the amount of all bounties that have been paid. Care must also be taken that both final state ments given to the soldier arc exactly alike in every particular. Ou the final statements of a colored soldier, not a slave April 19th, 1861, this remark must be clearly stated, "Free on or before tho I9th of April, 1861,” (vide General Orders No. 120, scries 1861, Headquarters, Department of the South.) • Any officer, in future, who is known to give a discharged soldier an incorrect, or incom plete, final statement, will be arrested and tried before a Court Martial for neglect of du- ‘y- By command cf Maj. The following General Order from the War Department, is hereby published for the information of this command: WAR DEPARTMENT, Adjutant Gexebal’s Office, Washington, July 8, 1865. [Gexebal Obdebs, No. 122.] Regimental Officert of Volunteers on detached term rice to join thein proper commands, I. With the exceptions hereinafter enume rated, the following is ordered: 1. All commissioned officers of Volunteers, for both white and colored regiments, or inde pendent companies, now absent on detached service from their commands, and not on duty within their proper armies or Departments, will proceed, forlhmth, to join their respective regi ments aud companies. 2. Hereafter, no commissioned regimental officer of Volunteers will be placed on duty, or transferred thereon, out of the Army or Depart ment in which his regiment may be serving. The exceptions authorized under the foregoing are us follows : 1. Officers on duty mustering out and dis charging the Volunteer forces. 2. Aides-de-Camp to General Officers on duty commundiny troops. 8. Officers oh Courts Martial or Military Commissions, arid those on duty in the Bureau of Refugees, Freedmcn&nd Abandoned Lands, under direct orders from the War Department, Adjutant General s Office. II. All enlisted men, absent on detached ser vice from their regiments or companies and outside tho Armies or Departments in which the same may bo serving, will at once be sent to join their respective commands, unless they are absent therefrom by orders from the Head quarters of u Military Division or superior au thority. III. Commanding Generals of Departments and Armies are charged with the prompt exe cution of this Order, and, upon its provisions being fully complied with, will report the fact to tho A<4jutant General of the Army. IV. No coiuhiissioned officer or enlisted man absent in violation of Ibis Order, will be paid outside tlie Army or Department in which his regiment or company may be serving. C., July 15, 1865. [Gexebal Order No. 8.] Repeated complaints having been made to these Headquarters that the Frecdmen and Women are frequently driven from the planta tions upon which they have been engaged in cultivating tho crops during the present year, therefore it is ordered, That the Frecdmen, women and children, who have been engaged in cultivating the lands the present year, will not be driven away.— They will be allowed to remain until the grow ing crops are harvested, unless dismissed by Military authority, ora Provost Court, and will be entitled to receive fair compensation for their labor. It is therefore required that equitable con tracts in writing be made between the Planters and the Frecdmen and women for the coltiva- tion of the lands the present season. Payment in kind will be made, and the al lowance of one-half the crop is recommended as fair compensation for the labor, the landlord furnishing subsistence until the growing crops arc harvested. These contracts will be submitted to the nearest military commander for approval. When the above contracts <t{e complied with, protection willsbe grantedas far as military ne cessity will pHow; but when no contract is made, the crops are liable to be considered for feited for the use of the laborers. Should the owners refuse to cultivate the lauds, or to comply with this order, they will be considered as endeavoring to embarrass the Government, and will be treated accordingly. Whereas, it is reported officially that a large number of destitute refugees, taking advantage of Circular No. 6, from this Bureau, have been transported South, against their interests, to places where it is extremely difficult to procure food, and, in most cases, Impossible to do so except when provided by military authorities, it is ordered that hereafter no transportation be granted to refugees, except where human ity evidently demands it, and then only by the requisition of the Commissioner of this Bureau. [Gebebal Orders, No. 102.] With a view to establish and preserve good order, settle disputes, encourage industry, com pel obedience to laws and orders and educate the poor, the following rules and regulations are hereby eetabUshed, and will be put in ope ration throughout this Department with as lit tle delay as practicable: I. III. The Superior Provost Court will habi. ually hold its sessions at sub-district head quarters, and be presided over by the Assistant Provost Judge, who may associate with him, one or two respectable loyal citizens, giving the preference to local magistrates, other things being equal. IV. Circuit Provost Courts shall be held at important points and at stated times, withiu the sub-district, and shall be presided over by one of the members of the Superior Provost Court, designated by the sub-district comman der for that purpose. The president of the Circuit Provost Court may associate with him one or two loyal citizens or magistrates. V. The courts above named shall have pow er to try all cases between citizens ami soldiers, and all crimes and all violations of military orders and the laws of the United States which do not come within the jurisdiction of a court martial, and to issue the usual process for tho attendance of witnesses, and decrees for the possession of property, and for the payment of debts, damages and costs. The decrees will go only to the right of possession and not of property. They may impose fines not exceed ing one hundred dollars ($100,) and imprison not exceeding two months." Offences by citi zens requirinm a dfeverer punishment, will he tried by a nnmary commission. They will ap point their clerks and other officers, shall keep a record of their proceedings subject to the revision of subdistrict and higher com manders, and will adopt rules and forms of proceedurc, which shall be as simple as possi ble. Citizen members of courts may be allow ed three dollars for each days’ attendance. The fees charged will be merely sufficient to pay all expenses. VI. Appeals from the Provost Courts will be had to the sub-district and district com manders, under such rules and on*such terms as the district commanders may provide. VII. All parties to suits before the Superior or Circuit Provost Courts may employ counsel. But all persons bringing suit or appearing as counsel before tmid courts, us well os the cit izen members of said courts, will be required to give proof that they have taken the oath of allegiance. VIII. It is the duty of the .military author ities throughout tills Department, when cal led upon to do so, to aid the assistant commis sioners and agents of the '• Bureau of Refu gees, Freedmen and Abandoned Lands,” in the execution of their duties under the laws of the United States and the orders of the com missioner of said Bureau issued in accord ance therewith ; and. when there is no sucli assistant commissioner or agent upon the spot, to take cognizance themselves of all violations of such laws aud orders. AH cases of such violation may be tried before the courts herein above authorized. IX. AH cases properly coming within the jurisdiction of these courts will be brought to trial promptly, and all unnecessary arrest of citizens will be avoided. X. The existence of the courts hereina bove authorized, will cease whenever and wherever, the functions of the officers of the civil laws are restored to operation by proper authority. XI. District and sub-district commander* arc directed to provide, whenever practicable, for the education of the children of tho poor within their commands, and for that purpose they are authorized to detail regimental chap lains and non-commissiuncd officers and pri vates for teachers. The education of the children of Refugees and Freedmen will he relinquished into the hands of the assistant commissioners and agents of the Frecdmen’s Bureau, whenever they are in readiness to take charge of the same.
