In all easts ot divorce the law was
plain and the ant lenities overwhelmii

swer that, the marriage in question
was a bigamous ami polygamous one,
and the allegation*, not being denied,
must be taken as true. It' such a

by defendant equity wilt open its
doors lor her reliel; but upon the ease
a* i' stands, it is not, in the judgment
ol the Court, according to the prinei).|im
mI equity or good conscience to

thai the alleg(d mat riage was celebrated
in 'his city, and that the* plaintilV
and defendant both reside in this city.
It cannot therefore be a dt(lienIt or
expensive duly for the plaintiff to
place upon record a confirmation or
some explanation ol the unexampled
and extraordinary allegation made if
any just explanation exists; and the
('unit holds thai such explanation is
due to the common principles of equity
and public justice before proceeding
further in tiie direction sought.
It would be st range indeed if upon
such a state of fact*, uncontroverted
hy any rule of pleading or ol law, and
unextenuated by any evidence, it
could be imposed as a duty upon a
court of equity to diiect or enforce
payment ol alliitxmy, and thus bestow
apparent, it not indeed real, sanction
ot the law upon a practice which is
lm>tilc to the civilization of the age,
am! which the penal statutes ol the
bind visit with condign punishment.
