A dense cloud was lirst soon approaching
tlu' mill pond, being apparently
a considerable, distance no. !

Nothing particular was i iioiitillt ol it, j

necurred. 'i 1m- cloud had hailed over
the pond and established connection
with the latter. A genuine watt l
spout had in huM heeu evolved ami an

ductor. When first seen, the water
Spout was near the dam, and travelh-tl
slowly across the pond unlil if
reached the railroad trestle work, a
distance ot a mile and a <(uarler from
its starting point, w I en it. disappeared,
and the cloud moved majestically oil,
carrying with it thousands of gallons
of water which had heen drawn from
the pond. The latter covering an
area ol si\* hundred acres was. in (net

lowered fully I wo inches.
The huge column which joined the
upper rtgton to the expanse ol water
below resembled a cone in form, and
rotated horiy, out ally with exceeding
rapidity. The marvellous speed with
which the column turned impressed
the beholder immediately with the
idea that it was associated with a
whirlwind. This was most probably
lite case, as a tremendous wind passed
over Augusta from the direction ol
Langley some hours afterwards. The
heavens were brilliant with incessant
flashes of lightning alter the spout
described above had disappeared.
There was no rushing noise connected
with it, as is the case in some install
ccs. I lie water in the pond just helore
the spout tunned was in a slate
of great agitation. Waves rolled
angrily and a perceptible bulge was
seen. As the cloud halted a sort of
funnel protruded from it and dropped
slowly down, becoming larger as it
lengthened, the broader portion or
base being at the surface of the cloud.
When it reached a point about onefourth
the distance between the cloud
and the pond the bulge on the surface
of the pond rose to meet it, and the
two at length joined, when the water
from the pond commenced assending
into the cloud, which moved slowly
towards the trestle work. Tho waves
in '.lie water?all leaping and tending
towards the spout?and the spout
itself continued the vertical motion
referred to above.?The outside of the
watery funnel was dark and r.ot well
defined, while tho center was much
lighter, being rather ol a bluish cast.

There can i>o no doubt but that the
immctiscd quantity of water w hich i
was transferred from the pond to the
cloud was literally sucked up. The
spout finally disappeared, and, as if it
had been draw n bodily up into tin4 I
cloud, while the latter quietly moved
olV to narts unknown. Not a drop of
rain fell during the occurrence or after '
wards. The formation and subsequent
motions of the spout are described
as having made up a spectacle
grand in the extreme. Nothing of
the kind was ever before seen in that
section. The strangest part of the
phenomenon was the fact that the j
cloud, so burdened with water, moved
oil' without dispensing any of it in the \
form of rain in the neighborhood.

land, is the adoption of such measures

ing rows; but by supposition the
soil is "already exhausted ol its fertility.
How to restore it to its former productiveness,
is the' question. Mr.
lli.von says the answer to this question
was suggested in his boyhood,
lie had observed, that new lands were
more productive than old, and that he
accounted he* it, in the fact that new
lam! was lull of decaying vegetable
matter, while old worn-out soils were

Hut how to keep up the supply

11' i lie land is nheady exhausted so that
it will no longer produce ol itself any
green crop*, then of course we must
resort to some out-side means of suppis
ing, such as hauling injleavcs, scrapings
irom fence jams, muck, etc., but
as a general rule, it is much cheaper
to make the land produce its own supply,
ami in the South, this can usually
be done by means of the pea crop.
II we turn under in the fall a crop
even of green broom sedge (and there
is very 'ittlo land in the South that
will not produce) broonistraw) and
then plant peas in the spring and as
soon as they begin to bear, turn under
and plant, again immediately, we may
ha vo a second crop to turn under in
the fall and then seed with wheat and'
clover. The soil will be so far restored
in one year, as to bring a good crop of
wheal and clover, and has therefore,
reached.a point where it may henceforth
he kept supplied with vegetable
matter so essential to its productiveness.
If the roil is unadapted to clover,
continue to seed peas. J>y this
nroeess we may keep land up to its
original lerlility. lint there may be
elements wanting in the soil necessary
lor the highest point of productiveness
(all new soils arc not equally productive)
and, which can, and ought to
be supplied by the intelligent farmer.
'I he soil may need lime, potash, phosphoric
acid, or some element of fertility
not to be found in the soil itself,
and which must be bought in the market.
Nitrogen or Ammonia may be
supplied by the decay ot vegetable matter
and the farmer can therefore get a
suppply at home cheaper than in the
market. Our red clay subsoils usually
abound in potash; and hence we
have only to bring it to the surface
by means of deep plowing. Where

with liis resources ol vegetable matter,
and his supply ol cotton seed, is under
no necessity to pure tasc ammonia, it
his resources arc properly husbanded,
but if he will not gather up the supply
at hand, it is perhaps better to buy
than to attempt to farm without the 1
necessary supply. |

to the Circuit Court ol tlio
Cnited Stales for trial under a statute
(?l Congress, which authorized persons
engaged in revenue service to havo
causes ei her civil or criminal which
may arise in our State Court, against
them, transferred to this Court,
tor adjudicat ion. We have already oxpressed
the opinion that the killing in
this case was nothing short ol Initial
murder. Davis was no outlaw.
There was no bench warrant a^iinst
him, and he was charged with no eapital
felony. He had not t'orleited his ^ ^
right to livo, and even an ollieer t'Otil?I
not legally deprive liim ol it. Ho wan
a citizen eutitleil to the protection of
his country's laws even il he himself
violated those laws. Justice did not
call lor his death even if he hail been
| convicted ol the charges against him,
and is it possible that a olheor, a creature
o! the law to enforce its provisions
could inilict a greater penalty
than the law itself? Davis was an
humldc citizen and an erring man, yet
his life was precious to some, and no
one was vested with authority to rob
him and his family ol that lite. J>ut
it was done and Mattison did it. lie
has been removed from trial in tho
County where the crime was committed.
We have exajniited tho law for
t ie removal and it is indeed an extraordinary
statute. Its provisions are
gen ral. It snvs any civil or criminal
caivc without specifying any particular
ciiinc or imposing any penalty.
11 simply gives the right ol trial to
tlie Cnited States Circuit Court.
Now this court is created by statute
and only has jurisdiction in cases given
it by statute. There is a statute
| against it in the States and no penalty
isaflixed to the crime. Therefore it is
a matter of serious doubt, as to whether
t bo vogue language to which wo
have referred gives jurisdiction in
these cases and there is much ^renter
doubt whether any penalty can bo
imposed if he should be convicted.
The statute must bo unconstitutional
or State rights are totally destroyed,
and their courts bad better be closed
forever, il Congress can exempt one
class ol persona from the operation of
State laws. This case seems to present
a nice case for settling this conflict,
of jurisdiction, and we hope that.

Mattison, and that Judge Cook will
issue a bench warrant to bring him to
trial, upon the ground that the Stato
Court has jurisdiction and the t inted
