Keeping in repair highways, the Cotin;y
Commissioners of eaeli couty shall I

of roads in each highway district,
whoso duty it shall he to have the
persons helore named warned out to
work the said roads whenever he may
leem it necessary to repair the same,

Sice. 4. Any person liable to road
duty, w ho shall have been duly warned
two days betore the day lixed in his '
notice for such working, stating the j
hour and place of working, shall be

highways ami roads (having no justifiable
excuse), according to the direcrection
of the overseer, lie shall he

suddenly obstructed by storm or otherwise,
so as to require immediate ;

Skc. 0. ll any person receive bodily
: injury or damage in his person or properly,
through a delect in the repair of
a highway, causeway or bridge, lie
may recover in action against the
county the amount of damages lived
by tin; finding of a jury. Il such delect
in any road, causeway or bridtro
existed before such injury or damage
occurred, such damages shall not be
recovered by the person so injured, il
i his load exceeded the ordinary weight
of the county when such injury or
damage occurred.
Skc. 7. II, before the commencement
of an action provided lor in the
[foregoing section, the County Commissioners
tender to the plaintiff the
amount which he might he entitled to
recover, together with all le^al costs,
and the plaint ill' re (use to accept the
same, and does not recover upon a
subsequent trial a sum larger than the
amount so tendered, the defendant
shall recover costs, arid the plaintiff he
entitled to the results of no verdict.
It the Commissioners of any county
neglect to have repaired any of the
highways and bridges which by law

shall he deemed guilty ol a misdemeanor,

to cut down and make use of any t imber,
wood earth or stone in or near
the road, bridges or causeway, ior the
purpose of repairing the same, as to
