We had a conversation with a prominent
Democratic politician in this State yes'
terday, and were much amused to see
how he had searched the records to find
something by which to recommend Judge
Davis and claim him as a Democrat. He
succeeded, too. Judge Davis was the
Judge of the Supreme Court who give the
decision in favor of "Son-of-Liberty"
Mllligan in 1S64. This act alone will endear
him to the hearts of Indiana De
mocrats, no matter how radical he may
be in other respects. Defend the "Sons
of Liberty" and a democrat will love you
as a brother.
The liberal Republicans will leave this
choice bit out of their speeches and will
praise Mr. Davis for his vote on the bench
against the late legal tender decision.

We have a new applicant for state
privileges. Another star wishes to come
out of the territorial milky way and shine'
with added lustre, among the planets of
our Union system. Utah had a special
election on the 18th inst., by which a new
constitution and state organization were
adopted. It prohibits polygamy aDd fortifies
the prohibition by enactments which
look like good faith. The chief objection
to the new instrument is that the principle
of the secret ballot was excluded, by mormon
influence, and also it in roduces
female suffrage, 'lhe "Gentiks*' think
this is legalizing the Ilarems in a new way
and refraiued from any participation in
the convention or election. There is no
probability that the state will be admitted.
The population is insufficient and
there is a strong opposition in and out of
Congress to any more "rotten pocket
boroughs."

The other evening we listened to Bayard
Taylor lecture about Schiller and his
poetry. Mr. Taylor is thought to be one
of our finest German scholars; is profoundly
learned in the literature of the language;
while his love for Schiller auimates
him throughout the lecture, provoking
him to all the more thoroughly do justice
to his subject. As prefatory to his special
theme, the poetry of Schil er, hq gaye us a
succinct history of the poet's early days;
his poverty and obscurity; his studies, sufferings,
wanderings about the country;
his distress and want in Manheim; his
meeting with Wieland and Goethe, and
then his subsequent success. Led by the
lecturer's art we felt acquainted with
Schdler; and walked and talked, laughed

him victor over adversity and obscurity,
honored and loved by his c >untry.
But it was as a critic kindly aud full of

Carious Defence.
The Frankfort (Ky.) correspondent of
the Louisville Journal writes the following:

There is in the ante room of the Court
1 of Appeals, in the Capitol building, a
crayon portrait whereby hangs a curious
story. It is the likeness of a gaunt, an- h
gular, shabbily-dressed "cracker." whose "
whole appearance is forbidding, and whose &
countenance is peculiarly repulsive?such
a creature as a man would meet with dis- a
gust and a woman with shuddering abhorance.
But it is the portrait of a witness
whom the husband of a wife in Coving- ~
ton, in this State, brought forward to tes- ^
tify that he had had illicit connection with a
the plaintiff s wife?the case was a suit (
for divorce, in which the husband was w
plaintiflf-and did depose that the wife 8
not only committed infidelity with him, ,
but absolutely made all the advances herself.
The divorce was granted in the in- .
ferior court and carried up by the wife to
the Court of Appeals here. The portrait
in question was filed by the injured woman
as evidence to the effect that it was
impossible that she should have been faithless
to her husband at the instance of
such a monster, much lees that it had been ^
euilt of her own s eking. Chief Justice
Robinson sustained the plea on this
