lie was born in a small frontier village
" on the Big Blue River, in the northern
portion of Jackson County, in the State of
Missouri, in the year 1S29, but does not
remember the month. "When but a mere
lad he gained a great reputation among
the hardy backwoodsmen and trappers of
that section as a wonderful shot, as he
had been known to bring down a deer at
four hundred 3ards. At eighteen he was
a successful trapper, and knew every elk
path and otter pond for miles through the
wilderness. Hi? shrewdness attracted the
attention of Bent, the great St. Louis
fur tradder, who secured his services when
nineteen. It is to this incident that his '
subseejuent misfortunes and ten years' cap- ,
tivity and sufferings among the Comaneh- i
es may be attributed. Shortly after entering
the service of the fur company, as 1
the Captain related, he and a companion, !
Jean Batties, a French Canadian, were j
sent to ihe Cimerone Springs, near the
headwaters of the Arkansas river. At ^
that date the whole country was almost a ,
howling wilderness, with but few settlers i
scattered here and there, and wasswarrn" <
iDg with hostile Apaches, Pawnees, and 1
the seourge of northern Mexico, the j
blood-thirsty Comanches. On the 17th of ,
September, 1847, a9 their luck had been (
bad, Batties proposed to Hobbs to start (
further 60uth, where gam:> was supposed <
to be in abundance: the latter acquiesced. '
During the evening of the first day's trip j
Kobbs trailed a bufthlo. His capture is 1
given in his owi^ vernacular. "Putting (
spurs to my mare," said the Captain. "I
soon overhauled the varmint, which j
proved to tea cow, which I killed. Bat- ,
ties soon joined me, and after we cut oft* (
all the meat we wanted we built a fire and .
bunked in for the night. The following (
morning, while preparing our grub, a war (
party of twenty Comanche braves, with (
eight or ten Pawnee scalps, and a drove j
of stolen ponies appear: d on the scene. ,
The leader of the band advauced toward ?
me with outstretched hands, and growled \
out Tlowj" I answered him in a friendly t
way, still keeping an eye on my shooting- j
irons. All of a sudden one of the most t
demoniac yells that ever greeted a mor- t
tal's ears was given, and before we could ,
move the whole pack of hell-hounds were
upon us two poor devils. They killed (
poor Batties before my eyes, scalped him, i
took oft*his moccasins, secured his rille ?
and ammunition, and then made for me. ]
But the Chief somehow, took a fancy to :
me and drawed oft' his pack after thev ,
had almost fiuished me and had the knife t
to my scalp. Look here," so saying the v
Captain parted the thick black hair on the \
side of his head and a long white scar was j.
revealed. "That's the commencin, place," J
he resumed, ' and in two minutes' time ?
longer I expected they would have raised (
my top-knot, for certain. Do you see
# this?" Here he pointed to a deep scar
just above his mustache, at the right of the
nose, "That's another mark they gave j
me with a tomahawk on that occasion.
Well, to make a long story short, they
carried me with them up to the mountains.
They danced around me, sung
and nlaved on the tomtoms near-Wall
night, and to wind up they cut off my hair i
and commenced to cut up my face, or
what you might call it, to tattoo me. I
objected so strongly that they stopped it,
but they managed to put a brass ring
through my nose. This I wore during my
ten years' captivity. I was made a warrior,
and went out with them on all their s
war and marauding expeditions across j
the Mexican border, and several times a
came near losing my life while fighting the :
Apaches and Pawnees. All told, my body <
bears seventeen bullet and arrow wounds."

years before I was made a warrior. About
six months alter this event, while hunting
alone in the mountains of Lower Sonora, j
I heard the breaking of a twig not far ,
from where I was standing. I cocked my
ritle, thinking it might be a cinnamon '
bear. I did not hear the sound again,
but instead saw the cause of it m the
shape of a big Pawnee warrior who stood
partly concealed in a clump of chapparal
about 200 yards distant. "We looked at ,
each other fully live minutes without t
drawing a bead; suddenly he raised his j
gun and tired at me without taking aim.
I jumped to the right and escaped, still
keeping an eye on the Pawnee; he dodged
around, but 1 soon let him have it square j
in the head and scalped him. When near- i
ing the lodges 1 got two ash poles and ;
stuck the ends of each iuto the ears of the ;
scalp?it's the style of the Comauehcs to
take ears and all?and marched into camp.
Five minutes later seven hundred warriors,
headed by OldaWolf, whom the Uni- <
ted States soldiers and Mexicans well
know to their sorrow, surrounded mc, '
and such shaking of hands and hugging 1 ]
never experienced before. The chief the (
next morning gave me his third daughter i

queried the reporter. ' Oh, they're running
wild on the plains," replied the Captain,
laughingly, lie said that in the Fall
of 1847, after numerous lights with the
"United States soldiers, during which lie
tiied to escape, (rather dubious, ) the Comanehes
concluded to sell him and another
white prisoner named Kirker. Thus,
after ten years of captivity, he was taken ; ;
to Fort Bent, and was sold to Col. Sumner,
of the Sixth Cavalry. The Captain f >
was ransomed for six yards of red llannel,
one pound of tobacco, and a string of
beads. Kirker was sold for eight yards of
curtain calico, and a pound of common
Missouri tobacco. After being ransomed, !
the Captain sought the home of his youth; ,

The question having been raised as to
whether the law authorizes the State Auditor,
upon th<- approval of the Governor,
to extend the ti.ne for the payment of
taxes, after a careful examination of all
the acts bearing upon the subject, and being
unable to lind any authority for such
action, but at the same time knowing that
extensions, have been granted in previous
years, I submitted the matter to the Attorney-General
for a legal opinion.
In reply to the question alluded to, the
Attorney-General answers: "I have the
honor to say that the only section under
which it is claimed, so far as I am aware,
that the State Auditor, with the approval
3f the Governor, may extend the time for
the collection of taxes, is the 147th section
of the tax act. That section is in
these words: 'If any of the duties required |
to be performed in this act on or before a
certain day by any officer herein named
:annot, for want of proper tipie, be soperormed,
the State Auditor, with the approval
of the Governor, upon proper evileuce
of the necessity of the same, may extend
the time as long as may be necessary
.here for.'
An examination of this section will, I
ffiink, lead to the conclusion lhat it has
reference simply and only to an extention
pf time necessary for the tax officers to
perform their duties, and was not intended
to, and does not in terms,authorize an
sxtention of time for the payment of taxis.
I am aware that a different constructon
has been acted upon for the past three
irears, but now that the question is presented
to me for the first time for my opinon,
I am obliged* to say that I do not
,hink this section gives authority to you,
ipon the approval of the Governor, to ex,end
the time for any other purpose than
,o allow the tax officers to complete their
prescribed duties."
The law as construed by the Attorneygeneral,
in whose opinion IJully concur,
loes not allow the exercise of discretioniry
power to any officer in this matter.
[ would therefore once more bring to the
lotice of all the importance of prompt and
punctual payment of taxes, as under the
lecision above quoted I cannot do othervise
than execute the law, as provided for
n the 97th section of the Tax Act, passed
September 15, 1808, which says that the
penalty shall attach upon all taxes aud as
lessments not paid on or before the 15th
