INVESTED CAPITAL CASE BEING HEARD Most Important Suit of Kind in A Decade?Millions Involved. Washington, Jan. 8.?Arguments were begun today in the supreme court in the "invested capital case" characterized by Solicitor General Frierson as "the most important le gal suit from the standpoint of gov ernment finances in a decade 'Wheth er the government will be forced to tetum hundreds of millions of dol SaTs paid as income taxes depends on the outcome. The immediate cause at issue be fore the court is the appeal of the LaBelle Iron Works from a ruling ox the bureau of internal revenue re * * oiirvro it to troat as invest lUOlU^ bV ntivn 4V vv ed capital the value of ore lands which it had purchased in 1904 for $19,000 and which by 1917 had in creased to $1,000,000. The govern ment agents maintained that the in crease in reality was "profit" and should be taxed as such. The com pany added the increase to its capi tal invested and claimed the normal deduction of per cent, paying under protest the additional tax of $1,081, ?00. The question of whether a stock dividend is taxable arose in a new form in the present case, the increas ed value of the ore lands having been 'represented on the books of the cor poration, according to the govern iont'e Jwipf sinefc 1912 bv "stock is * sued as a stock dividend." The wide interest displayed in the ease in the business world was illus irated by the number of requests for permission to appear as "friends of ? the court.'"
