Any person desiring to : mport any alcoholic liquors under bis act shall apply to the judge of robate of the county in which he esides and file with him an affidavit hat he has not received any like ermit during the same calendar lonth, and containing one of the ollowing statements: "(a) The amount and kind of aloholic liquors desired, not exceedag one quart, that the consignee is iot a minor nor a student of any astitution of learning, and if a ' roman, that she is the head of a amily; the office of the common i arrier from which delivery is desir- < d and that same is the nearest office f said common carrier to the resience of the applicant, and that ame is desired for medicinal puroses; or, "(b) Applicant is a minister, pasor, priest, rabbi or regularly contituted officer of a regularly organsed religious congregation or church nd^the name and location of the hurch or congregation for which he same is desired, and that thb ame is purchased in good iaitn to >e used for sacramental or religious purposes, and no other, the amount ,nd kind of alcoholic liquors not exeeding one gallon of wine; or "(c) That the applicant is the tead of a family of the Hebrew aith, is not a minor, the amount ind kind of alcoholic liquors deired not exceeding one gallon of rine, and that the same is desired or religious purposes for use during 'assover. This application' shall >nly be filed during the month of darch of any year. "Upon the receipt of such affidait and the payment of a fee of 10 ents the said probate judge shall ssue a permit under his hand and ifficial seal to receive the alcoholic iquors specified, which permit shall :ontain the name of the consignee, he amount and kind of alcoholic liluors and the office of the common :arrier from which delivery is to be nade. "The said probate judge shall keep l record of all permit* issued in a >ermanently bound book, in which he names of the applicants are enured alphabetically and said permits ihall be numbered consequently and he number, the name of the contignee, the amount of alcoholic liluora and the office of the deliverng carrier and the date of said peroit shall be entered on said record. rhe said probate judge shall, out * " *? ?i ? "Sec. ll.No common carrier shall leliver any alcoholic liquors to any >erson until he has filed with the lelivering carrier a permit issued as ibove provided and aated within two reeks of said delivery, which pernit shall be immediately cancelled >y said common carrier. "Sec. 12. The making, uttering, or ising of any false permit shall conititute the crime of forgery. "Sec. 13. Whoever shall knowingy transport or convey from one >lace to another, or from one person ;o another, any alcoholic liquors | cnown by him to have been illegally iold or procured, shall receive the iame punishment as if convicted of ;he illegal sale of such alcoholic lijuors. Charges of illegal sale of al coholic liquors and illegal transportation thereof may be joined in the same indictment. "Sec. 14. It shall be unlawful for any intoxicating liquors to be stored or kept except for one's own personal use, or that of his immediate family, or for religious purposes, and then only at his usual place of residence and only when the same BUttU uavc uccu ytvviuvu am a u?nful manner. The residence of a person shall be where his family resides, if he has a family residing in this State, and if not, at the place where he usually sleeps; Provided, however, That it shall be unlawful for any person to have in his possession, or to store or keep, for any purpose, any quantity of such liquors in any room in which, or in connection with which, there is maintained or conducted any place of amusement, club house, fraternity house, lodge or meeting place, cafe, rest room, store, office, shop or factory and no such place shall be considered a residence within the meaning of this act "Sec. 15. Storage of any unusual amount or in an unusual way of any alcoholic liquors shall be evi- , dence of violation of this act. , "Sec. 16 It shall be unlawful for : JA /IsIivai* fA 1 tuiy tuumuu kuiiEi w < ?!.,?. j any minor, or any person not the consignee, or to any woman not the head of a family, or to any student ( of an institution of learning, or for any minor, or any person not the , consignee, or any student of an in- | Btitution of learning to receive any package containing alcoholic liquors "Sec. 17. The original record , which common cnrriers are required to make under the terms of this act shall he kept in the county in whi-.h ' tiie delivery of said alcoholic liqaorc is made, and if jpraeticable, at the same office making delivery, and said common carrier shall produce such records for the uke and Lonefit of any officer said county or of the .courts of the State when requested so to doy "Sec., 18. Any violation of tie provisions of this act for which no other punishment is provided, shall be punished by imprisonment for not more than one year, or a fine ; of not more than $1,000, or both. "Sec. 19. The words 'alcoholic Liquors' as used herein, shall be con- : ridered to mean any liquor, beer, ; beverage, or compound, whether dis- ; tilled, fermented, or otherwise, by ; whatsoever name known or called, ; which will produce intoxication, or ; which contains in excess of one : percentum of alcohol and is used as ; Et b6V6rfl^6# \ "Sec. 20. This act shall not affect ; any existing law regulating the ; transportation for, or the receipt, : Btorage. sale or use by druggists, : hospitals and laboratories, or for ; scientific or mechanical purposes of : alcohol or preparations containing : alcohol, or any law regulating the : transportation and storage of medi- ; cines or extracts which shall re- ; main as heretofore; and provided, ! That this act shall not apply to al- : coholic liquors or sanatoria bona ; fide established and maintained for : the treatment of patients addicted ; to the use of liquors, morphine, ! opium, cocaine, or other deleterious drugs, when the same are adminis- ; tered to patients actually in such : hospitals or sanatoria for treatment, : and when the same are administer- : ed as an essential part of the par- : ticular system or method of treat- : ment and exclusively bv or under : the direction of a duly licensed and I registered physician of good moral I character and standing; And pro- I vided, further: That shipments of Buch liquors be shipped in the name ; of sucn hospitals or sanatoria, and ; that the amount of such shipment < shall not exceed five gallons in any < one calendar month, and no permit ; shall be required therefor. For Industrial Purposes. " * ^ ! "Sec. 21. That any person, uxui, ; or corporation manufacturing in this ; State ginger ale or similar soft ; drinks, in which there is an alcohol- ; ic ingredient not exceeding one- ; third of one per cent, may import ; alcohol into this State, or order and ; receive the same from another State ; in quantities not exceeding 10 gal- ; Ions, for which no permit shall be ; required: Provided, That such per- ; son, firm or corporation first file ; with the clerk of court of the coun- ; ty in which said manufacturing ; plant is located a bond with an ap- ; proved surety company as surety m ; the sum of $1,000 to be forfeited to ; the State upon proof of misuse of ; such alcohol or disposition of it ; otherwise than contemplated in this ; section for the manufacture of the ; said product. The solicitor shall : bring action upon said bond upon ; information or belief as he may see J fit J "Sec. 22. This act shall not affect ! any existing law regulating the manufacture, sale or disposition of ' ethyl or methyl alcohol from saw- J dust, slabs or other wood substance, which shall remain as heretofore. "Sec. 23. Any person shall have i the right to manufacture not ex- ! ceeding five gallons annually of wine < from fruits, berries or grapes, and < to keep the same for his own use and that of his immediate family, or for sacramental purposes. j "Sec. 24. The making of any false or untrue statement in any affidavit required herein, or the taking of j such affidavit by arty officer or per- : son who knows same to be false, j shall be deemed a violation of this J act. "Sec. 26. That if for any reason < any section, paragraph, provision, < clause or part of this act ? shall be < held unconstitutional or invalid, that j fact shall not effect or destroy any ; other section, paragraph, provision, ?orf of tlifi act not in and < of itself invalid, but the remaining portion shall be in force, without regard to that so invalidated. Agents Indictable. "Sec. 26. Should any agent or agents of any common carrier violate any of the provisions of this act, the said common carrier may be indicted, and upon conviction, fined for such violation, and in addition, such agent or agents, may be personally indicted, and upon conviction, fined or imprisoned, or both for the same violation, Jurisdiction of said common carrier, if a corporation, shall be obtained by serving upon said corporation a certmea j copy of the indictment against it 3 in the same way and upon the same persons as provided for the service sf a summons in civil actions. "Sec. 27. Any buggy, wagon, automobile, railroad car, bicycle, motorcycle, or other vehicle, or any loat, launch or other vessel used in Jie illegal transporting of alcoholic iquors, as herein forbidden, with foe knowledge or consent of the >wner thereof, or of the agent of inch nwrnr in fharc** nf mi>h vaVii. :le or vessel, is hereby declared forfeited to the State, and may be contacted by any peace officer, and ifter due advertisement, sold, and iroceeds paid into the county treaalry: Provided, That where said velicle or vessel is of greater value han $1,000, the owner thereof may it any time before sale redeem lame by paying into the county treasury the sum of f1,000 therof. "Sec. 28. The act entitled 'an act to regulate the shipment of snirit>us, vinous fermented, or malt liluors, or beverages, into this State, stc.,' approved February 20, 1916, is hereby repealed* "Sec. 29. The provisions of this wt are intended to be in addition bo the existing laws on the same1 lubject, and not intended and shall sot operate as a repeal of any such taws except in so far as same are inconsistent with this act "Sec. 80. This act shall take effect 60 days after its approval. "Sec. 81.
