THE VALUED CLAUSE.
That is an interesting, though unsound,
discussion of the fire insurance
situation as presented by Mr.
Wm. N. Graydon, whom recently we
have welcomed as a new citizen of
Columbia. Mr. Graydon objects to
the thought of South Carolina being
made to serve the insurance companies.
And so would we. But there is
no such danger.
The Record did suggest that Mr.
Manning's recomendations be taken
on faith. We think it would be

ments offered from the floor of the
general assembly, confusing rather
than clearing the situation. And Mr.
Graydon's letter is the strongest
proof of that. The weakness of Mr.
Graydon's statement consists in his
attack upon the integrity of insurance
companies, inferentially classing
them with offenders before the
law who "bitterly resent the passage
of prohibition laws." With citizens
in that frame of mind, no argument
in behalf of justice to the insuring
companies can be effective.
The fire insurance company cannot
appraise the value of all risks
when written. This would require
more machinery and would make the
business unprofitable. No honest man
will suffer by the repeal of the
valued policy law. A company cannot
afford to face public resentment
by making frivilous contests. At the
same time, if there should be a fire
upon which suspicion rests, as to
the over-valuation of the property,
the company should have some elasticity
in making settlements.
A policy is a contract, and under
the law the company is bound under
that contract to pay the amount stipulated,
even if the named valuation
be in excess of the real. The
insuring companies contend in their
justification that they have lost heavily
under such conditions,?Columbia
