Election Bombshell.
The dispensaries throughout the Stat
closed their doors last week preparatory t
the election which comes oil on Aucust lb
17th.
Since the closing of the dispensaries certal
lawyers of Charleston have found a flaw i
the law which knocks It Into a cocked hat.
The Constitution of the State says that tb
heading of au act muBt contain the subject <
the act. Here Is the heading of the act 1
question:
"An act to prohibit the manufacture, sali
barter, excbanee, giving away to Indue
trade, the furnishing at public places or ott
erwlse disposing of alcohol, spirituous, vlnoi
or malt liquors or beverages, or other llquoi
or beverages by whatsoever name calle<
which K drunk to excess will produce Intox
cation, except ior khi? ui mmuui
cases upon certain conditions, and except tb
sale Of wines (or sacramental purposes, an
to provide penalties for tbe violatlo
thereof."
It will be noticed that no mention 1b mad
In tbe above beading to voting In or out <
tbe dispensaries. Tbese gentlemen froi
Charleston claim, therefore, that the act 1
unconstitutional. A day has been set for
bearing and we will soon know what tb
court thinks about the matter.
If they take the view that that part of tb
act not mentioned in the heading does not ii
validate that part of the act mentioned, tbe
the State finds Itself a prohibition State 1

that tbe act, being in part nnconstitutiona
is all unconstitutional, then the dlspensarh

Because an act is wrong in part, is It a
wrong; or, can an act be partly constltutloi
al and partly unconstitutional? On tbe at
swer of these questions depends the issue i
prohibition or dispensary. In either ever
It seems that there will be no election th
year on the question. The court has ordere
that the commissioners go to no further ei
pense In regard to the eleotlon and that of H
self Is a straw which shows the way the win
is blowing.
It is not known, of course, what the com
will do. Some think that it will conBldi
that part of the act mentioned in the headlc
as constitutional and preclude the part not t
mentioned. Others think that an act, whlc
should be a unit in lUAslf, cannot be parti
constitutional and partly unconstitutional
that the cocrt will not allow such an act t
go on the statute book.
What we wish to know Is, who wrote th:
act. and whether or not there be method 1
bis madness. Sometimes a man is not ha
so crazy as he seems to be and such may ti
the case in this Instance.
It is to be hoped that the omission In tb

They are exponents of a religion that n
man can destroy. They are living sermon
that preach stronger than masters of the pa
pit or the pen. Before these the argument
of the unfaithful would fade away like mist
before the morning sun. Of faith, they ar
proofs unanswerable, unfatbomed, glorlou
and full.

upon them, encroaching upon their pleasure
of this world; but Faith and Hope more thai
fill tbe void, and only joy marks their reaig
