MB.LY0N ANSWERS CHARGES Replies in I>elntl to Attaekft Made 1'pon Him. Injustice to my friend, Mr. Lyon, I take pleasure In publishing the following statement. W. W. Bradley. Columbia, July 7.?Special : Mr. Frasei Lyon has but a briel lime, at best. In hlispeecbes as candidate lor Attorney General. Mr. Ragodale, hit opponent, has pihced much emphasis on Mr. Lyon accepting pay aB a member of the Legislature and as a membei of the Investigating committee lor the time the committee met during the session of the General Assembly, and for other matters. Mr. Lyon does not have time to discuss these side matters, but wants to devote himself in his speeches to the dispensary and other vital issues. He has Just prepared a reply to the references made at Lexington and elsewhere, and hopes that what he has to say will be M read by everyone Interested. W What Air. Lyon has to say la brief aud Is atfollows: Mr. Ljou'n Statement. "It Is my desire to call the attention of tbe people 02 South Carolina 10 some facts relating to certain charged that bttve been preferred against me by those who are politically hostile, and to give answer thereto. NecetBarlly the time allowed for each speech on the stump Is short, and such charges cannot tben be answered fully. Besides, I prefer to discuss Issues before tbe people and avoid personal friction on the stump, ; As to tbe charge that I have received "doable pay" lor services rendered the State, I will say that no double pay" has ever been asked or received by me. I was paid the usual compensation as a member of tl.e ' Legislature, and was paid tbe compensation provided by law for my services as a member of tbe dispensary Investigating committee. During tbe past session of tbe legislature our committee waB In session for ten days and I received ?4 per day lor this extra service, which was no part of my duly as a member ol the House 01 Representatives. In addition to the above I received pay for two trips on tbe business of the committee, which tootc two or three days. The following letter was written by Senator J. T. Hay, who Is everywhere regarded as an honorable icentleman, a lawer of eminence and ability, an experienced legislator and tbe chairman of tbe Investigating committee. Under the law Senator Hay passes upon tbe itemized accounts of eaob .mem ber of the investigating committee and draws all checks on the treasury id payment thereof. Letter Froin Senator liny. Hod. J. Fraser Lyon, Charleston, S. C. ?My Bear Sir: In reference to this talk about members of tbe dispensary Investigating committee bavlDg received "double pay" I will say: No member bas received "double >pay" for any services. During tbe last session of the Legislature much work was done by some members of the committee. Tbe duties of those members as members ot the Legtslaiure were Dot lolerferred wltb. They did their full duty to tbe sessloD. But some of them did more In tryiDg to discharge duties Imposed udod them by the General Assembly, which duties had no connection with the busloessof (he session, and which st'emed to be Imperatively demanded, and which hud to be per formed at some time and paid for as provided by tbe law nnder wbicb the committee was acting. In doing this work those members of the committee wbo did anything did not spare themselves by ! any considerations of time, comfort or health. They bad not a minute tbey could call their own?scarcely taking time to eat or sleep. Tbe resolution under which they were working provided pay lor these serin the work done by the dispensary lnves. . *. Heating committee during the session of lUOtf they were not noting as members 01 the Legislature In business pertaining to the session, bill as an independent commission on business Independent o( ilie session. Any oue who is familiar with lecislatlve precedent nnd practice knows that I he commission are (.-niltied to pay lor work done Independent ot the business ulthc session. No question can be raised except by those who wish to discount the work ot the commission by casting some aspersions upon them or those who wish to gain some political advantage by posinu as no disinterested and patriotic that they would not receive compensation for services never rendered. I 1 can truthlully say that J. Fraser Lyon has j never received "double pay" lor any services rendertd by binj?in laet, he has never been I half paid. Yours truly, J. T Huy. Chairman Investlcauii}; Committee. An analagous case was decided l?y the Legislature wlien pay was provided for the Hon. T. 15. Fraser, over his objection, for set'vices rendered as a member of the committee to adapt the Constitution to biennial sessions, When he had been paid for the same tioie for services as a member of the dispensary Investigating committee. The appropriation for this will be found in Acts HKJC, page 221. The Hon. J. U. Kichards, ol Kershaw, and the Hon. I). O. Herbert, of Orangeburg, two as honorable gentlemen as ever graced the Leglsl ture, were instrumental In having this done. Kehiilt of the Kxli'ii Work. The practical result ol the extra work for which 1 r?ceivcd the rx ra pay was the cancellation of glass contracts of me dispensary with the Carolina Glass Company, which I tu v?fi i h? .siMie nrobttbl.v as much as S6U.00U, I hm appears by ttie testimony of Joe president of tbe South Carolina Uias? Company. Had this work been postponed until after the adjournment (if tbe Legislature these con tracts would not have utu cancelled by the Legislature and tbe Interests of tbe Slate protec<ed. Refetring to the complaiut as to tbe Itemized aecouuts of the members or the committee not being tiled it Is only necessary to nlve tbe history of the case. Ou tbe IStb of Janurfry. Mr. Hutto, of Lexlnton, Introduced a resolution (House Journal, page SSJ-'That the dispensary Investigating committee be and Is hereby, requested to lortbwitb furnish tbe House of Representatives, and the Senate au Itemized statement ot their expanses aud disbursements to date." Ou pages S7-02 a statement showing each check drawn appears. Etch lien!) Is given as li was paid by lue cbalruiau as provided by law. Again, ou the 8th dny of February, Mr. Hutto Introduced a resolution us follow:-: "That the dispensary investigating committee be, and is hereby, r? quested to forth with furnish tbe Honse of Kepte?>entallvm and the Senate au itemized statement of their expense* aud disbursements, the amount to whom paid and (ot what purposes, with all the vouchers covering the same; thai the said committee report Its tlnal findings before tbe end of this session of the General Assemblj; that no further appropriation be made for said commlttee.", "This resolution was not passed, an Its effect would havebeeu tantamount to au lmpeachmentol the honesty of Cbalrmau Hay. the discontinuance of tne investigation and a refusal to make au appropriation for tbe work ot tbe committee. As to the charge that I have been unfalthrut to my trust as a legislator, and that no one could have been elected lmm Abbeville County, had be opposed the dispensary, the following tetter will answer: Lowi desvllle, 8. C.. July 5,1900. 1 he Hon. .1. Kramer Lyon, Abb?\rlUe, 8. C.? Dear 8tr : 1 lake pleasure In slating that the Issue In the campaign of '1901, In Abbeville County, was whether the peuajty tax provided by the^Brlce Act Bhofild be repealed or oot. Tbis was tbe only phase of the dispensary that was discussed on (he stump. You took the posttloo th^t the tax should remain H8 It is lor the reason that It would create a lund with which to run out the "blind tigers" aud I took the position that a county should not be taxed lor voting out the wbUkey evil. Both ol us were elected notwithstanding we took opposite positions on tbls dispensary Issue. When tbis question came up In the House I voted to repeal the tax, as I bad advocated on tbe stump, and you voted to retain It, aeydu bad advocated on tbe stump. While I opj ose you on this issue 1 can say Irom personal knowledge that you have fulfilled every pledge jou made tbe people of Abbeville County. Yours truly, Jobn C. Lomax. I trust that the above explanations will be acceptable and convincing even to my op poueui. rs,eapecuuuy, J. Fraser Lyon. Followed au ENt?tl>U*he<l Precedent. Since writing this card Mr. Lyon has received a letter from Mr. J. Hampden Brooks, wblcb lurtber shows that It haw always been regarded as a precedent to do as Mr. Lyon aud otber members ol the committee dlil for services reudered outside of tbelr Legislative worfe.
