A.n Act to Amend Chapter XLY of
Title XI, Part I, of the General
Statutes, Relating to the Repair of
Highways and Bridges'.o
, it enacted, by the Senate and
Houso of llepresentatives of the
State of South Carolina,- now met
and sitting in General Assembly, and
by the authority of the same :
Section 1. That chapter XLY, of
title XI, part I, of the General Statutes
bo, and the same is hereby, re^
pealed, and the following substituted
us such chapter.
Sec. 2. The county commissioners
of the several counties of this State
shall divide their respective countics
into highway districts, and each district
to contain not less than two
miles of public highways, nor more
than thirty miles* to be convenient
for repairing highwa}'s, and tVolil liliiclo

Sec. o. I'hat for the purpose cf
keeping in repair highways, the colinty
commissioners of each county

near the roads, bridges or causeways,
for the purpose of repairing the same,
as to them shall seem necessary, making
just compensation therefor,
should the same be demanded; overseers
shall not authorizo the cutting
down of any timber trees reserved by
the orvner in clearing his land, or
hlilnted far the nurnosc of shade or

ornament, either in the fields, around
the springs, or about tho dwelling
houses or appurtenances, nor the cutting
of ahy rail timber when other
timber can be procured at or near the
place, or take stone or earth from
within the grounds of any person
inclosed for cultivation without con*

causeways or bridges, by gates, fences,
ditches, or any other obstruction, except
where authorized by law, or shall
hinder, forbid, or threaten any traveler
from traveling any public road;
and every person for such offonce
shall be deemed guilty of misdemeanor,
and upon conviction thoreof in a
trialjusticc's court shall be fined in a
sum not less than five nor more than
ten dollars.
Sec. 11. If any pet-sot^ liable to
perform such labor, shall remove from
one count}' to another, who, prior to
such removal, porformed tho whole
or any part of it; or in any other way
has paid tho whole or any part of
the amount aforesaid, in lieu of such
labor, and shall produce a ecrtiflcatc
or receipt, shall operate as a complete
discharge for the amount therein
