Loss of Public Records, and to
Perpetuate Testimony in .Regard
to Deeds, Mortgages, Settlement*
^nd other Papers, Lost by Fire at
Abbeville.
Section 1 Be it enacted by the

Sec. 3. That upon failure of the
party or parties, served as aforesaid,
to answer such application, in writing,
to be filed in the Clerk's Office within
twenty da}*s thereafter, exclusive of
the day of servioe, the Clcrlc of the
Court shall docket judgment for the
party filing said application.

Sec. 5. That said Commissioner
phall take, in writing, all the testimo
ny introduced by one or both parties,
according to law; shall hear and de
cide the mat tor in controversy, report
liia decision in writing, and, with it
return all tie papers to the Court of
Common T eas. From tho decision
of the Commissioner an appeal may
be taken to tho Court by tho party
pr parties di?satisfipd therewith, as in
case of an ? ppeal from the decision of
Referee ap;.inted under the Code. If
there be no appeal, the Clerk of the
Court shall docket judgment accord

Commissioner.
Sec. 6. In every case in which tho
defendant or defendants in any burn
ed judgment or decree shall !>e absent
from and without tho limits of this
State, in lieu of the service required
by this Act, it shall be sufficient to
publish, in a newspaper of Abbeville
County, one month's notice of such
application, and, if the absentee's

per containing the publication shall
pc majled to his or her address: Pro
vided, That nothing herein contained
shuii prevent such absent defendant
or defendants within two years after
the publication of the notice in this
Section provided, from moving.tbe

Sec. 7. Tho County Commissioners
for Abbeville County shall, forthwith,.

labelled "Abstract of Burnt Judg
ment and Decrees" in which the said
Clejk shall enter an abstract of every
such judgment and deprpe, a, new

tinct and appropriate columns, as near
as possible, the names of all the orig
inal parlies, plaintiffs'and defendants'
attorneys, the date of the signing of
the jujgiiicin or filing of the decree,
the amount ot the recovery the sum

which the int< rest began to run, the

Sec. 8. In any 'iusj prov ded for in
this Act, if the applicant, < r, in case
of his death, his personal r- presenta
tive. shall make oath, accord ng to the
best Qf his knowledge and hi- ief, that

which such lost or destroyed record

also as to the amount due thereon.
And in case such respondent, after at

propounded to him under the provi
sions of this Act.
coc. 9. That tho Commissioners of
tho County shall provide a book or
hooks for tho Clerk o}' the Court, ir
which the said Clerk t^hall record an
abstract of all tho deeds, convey
ances, mortgages, settlements, liens,
and other instruments in writing
heretofore recorded, and required by
law to be recorded, which fibstraet
shall contain a statement of the
names 01 tne panje?, a unvi mukv
ment of the property mentioned in
tho deed or other instrument, the
date of tfie paper, the time when the
registr}' was made, and the certificate
of such registry shall bo entered anew
on said paper. And tho said deeds,
conveyances, mortgages, settlements,
liens, and other instruments in wri
ting, shall be recorded as above pro
vided for within six months from tho
ratification of this Act, otherwise
they*shall not prevail as liens against
subsequent creditors or purchasers
for a valuable consideration without
notice.
Sec. 10. That in ease any deed, con
veyance, settlement agricultural lien.
<>r other instrument in writfng, shall
| have been duly recorded, and, after i
registr}*, delivered to tho owner'
thereof, and the*same shall have been
mislaid, lost or destroyed whilst in
possession of the owner, or in case of
any deed, conveyance, mortgage, set
tlement, agricultural lien, or other
instrument in writing requiring regis
try, shall have been delivered to the
Register with such intent, and shall
have been burned whilst in the office
of the Register of Mesne Convey
ance, and before redelivery to the
owner thereof, an abstract of all such
deeds, conveyances, mortgages, settle
ments, agricultural liens, and other
instruments in writing, shall be
proved as in the ease of judgments,
as aforesaid, and rc corded by tho
Clerk in the book or books, as order
ed in the preceding Section of this
Act.
Sec. 11. That nothing herein con
tained shall prevent any one from
establishing, pn the trial of any
cause, any lost or burnt paper, accord
ing to the rules of evidence now ex
isting. *
Sec. 12. Thrt the Judge of the
Eighth judicial Circuit shall have
power to appoint a person, who shall
bo called a Commissioner, 10 bear
and decide all questions to be referred
to him, as required qtider tho provi
jsions of this Act
Sec. 13j^The County Commissioners
areauthorized and reqnir.ci-to employ
the service of a competent person to
arrange properly, in the ne\y office of
the Probate Judge of said County,
all the records of the late Court of
Equit}' which properly belong to the
Probate Court, and which were saved
in a mixed and disorderly condition
from the late fire in Abbevillo.
Sec 14. That in cases where records
are altogether destroyed or burned,
the execution excepted, the execution
shall be tak?n as prima fwie evidence
of the burned or lost record.
Sec. 15. That by the substitution
and removal of judgments and papers,
as provided by this Act, no party
shall have any other or greater right
than would have existed had the
judgment and convej*anee, mortgage,
|settlement, Ken, or other instrument,
I in writing, never been burned, mis?
laid, lost or destroyed.
Sec. 16. The plaintiff shall pay the
costs of his application to replace and
rennw his judgment, as aforesaid, if
the defendant make default upon such
application or consent thereto. In
such cases, the plaintiff's costs, to be
paid him, shall be ten dollars for his
application. In cases where judg
ment does not pass against the defen
dant by default or by consent, and he
contests the plaintiff's claim or right,
the costs shall be the same as provided
by the Code, and awarded to parties
according to the Code of Procedure.
The feesof the Clerk and Sheriff shall
bo the same as now fixed by Jaw for
similar services, and those of the
Commissioners to lie appointed under
this Act the same as were allowed to
Commissioners in Equity by the Act
of the Gepevul Assembly of this!
State, passed in December, 1839.
