ACTS AND JOINT RESOLUTIONS PASSED BY THE GENERAL ASSEMBLY. [Published by Authority.] AN" ACT to Incorporate the South Carolina Agricultural College and Mechanics' Institute. Section 1. Be it enacted by tho Senate and House of .Representatives of" the State of South Carolina, now met and sitting in General Assem blj7. and by authority of the same : That a College and Institute of Me chanical Arts be established at Or angeburg, S. C., in connection with tho Claflin University, to be called the South Carolina Agricultural College and Mechanics' Institute, in accord ance vitn the provisions of the Act of Congress, passed July 2, 1862, and all Acts amendatory thereto. Tbe design of the Institution shall be to afford instruction in practical and theoretical agriculture, mechanical art and military tactics and training. Sec. 2. That the supervision and control of the institution aforesaid shall be vested in a Board of Trustees, in connection with the Board of Trus tees of Claflin University, to be known by the name, stj'le and litlo of the 1 Board of Trustees of the South Caro lina Agricultural College and Mechan ics' Instiliite; said Board shall consist of nioo (9) members, and shall be chosen by joint ballot by tlie General Assembly, provided that the first Board ot' Trustees shall be appointed by tho Governor, as follows: The first three shall bo elected for a term of three (3) years; the second three for two (2) years; and the third three for one (lj }'ear; a/id the General As sembly shall, annually thereafter, elect, by joint ballot, three (3) mem bers of said Board, whose term of offico shall be three (3) years; said Board may elect its own Chairman. mi . rn^?. .i il ^ 4 ^ 1 J. no j rusit'ub tnua uj>|;uiuit;u uuu elected shall, in connection with those of the Claflin University, constitute ono Board, and may elect a Chair man ; a majority of the Board shall constitute a quorum for the transac tion of business They shall receive no compensation, but shall be paid their traveling and other expenses while cmploj-ed on the business of the Board. Sf(c. 3. The said Board of Trustees shall be a body corporate, capable in law of suing and being sued, holding 1 and selling real, personal and mixed property, of contracting and being contracted with, of having and using a corporate seal, and of causing all < things to be dono to carry out the purposes of this Act, 1 SfcC. 4. Should anj* vacancy occur in said Board of Trustees, H shall be i filled by the remaining members of the Board. Sec. 5. It shall bo the duty of the Board of Trustees.to meet and organ ize, within thirty days after the pas sage of this Act, at the call of the Governor of the State, or any two ! nf t.lio Bounl. , Sec. 6. The Legislature shall appoint! a Board of Visitors biennially, who shall report each year upou the con dition and efficiency of this Institution. Sec 7. The Board of Trustees shall appoint a Secretary ana Treasurer, neither of whom shall bo a member of said Board. These officers shall bo required to give such bond as will se cure a sate administration of their duties. The Secretary shall also till the office of General Superintendent of this Institution, upon whom shall devolve u power of general adminis tration over all tho property of this corporation, for its better preservation and improvement, and who shall also have the power, at any time, to call a meeting of the Board of 'Trustees: Provided, That no power herein grant ed to the Secretary shall extend to making any material changes, except with the concurrence and authority of the Board of Trustees. Tho salaries of these officers shall bo determined by .the Board. * Sec. 8. Whenever the Board of Trus tees report that they are organized and prepared lor action, the (jovernor shall execute a draft on the State Treasury for the amount of interest due on the fund invested under the provisions of the Act of Congress and which.shall all bo under their en tire and exclusive control, as likewise shall all interest afterwards accruing from said fund. They shall also have full control af all moneys donated, appropriations, lands or property! whatsoever, coming into the posses sion of this corporation. Sec. 9. The Secretary shall reside on the grounds of the institution, and bosides exercising a general supervi sion overall the property under his Icare, shall keep a complete system of, rocords, He shall open correspond cnco with societies for the promotion of Agriculture, und make uso of such means to elicit information upon all industrial topics as shall bo conducive to the material welfare of the College, lie shall seek to obtain such contribu tions for the museums and library of said College as shall benefit the inter est of Agriculture and other indus trial arts and sciences. He shall also keep a correct account of all the pro ceedings of the Board, and an accu rate account of all the moneys re ceived in the Treasury, as well as those paid out. The Secretary shall report to the Legislature at every regular session, which shall embrace all such statements, accounts, slatis tics, essays and other information relative to Agriculture, as may be valuable, and also the proceedings of tho Board of Trustees of said College, to be approved by said Board. Sec. 10. The Board of Trnstees shall procure a site for an experimen tal farm, of snch size ns they may deem neeessay, to bo located as near as practicable to tho present location of the Claflin University, so as to combine, as much as possible, practi cal training with theoretical instruc tion in the science and art of Agri culture To carry out the foregoing provision, the Board are authorized to expend a sum not to exceed one tenth of the amount of Ujo fund to which this State is entitled under the Ar;t of Congress. Sec. 11 Students shall bo admitted into said College from each county, altera competitive examination among the scholars belonging to the public schools in such county, in proportion to the number of the representation in the Legislature. The time and mannerof conductingsaid competitive examinations to be regulated by the Rti;ir<l of Tviifit fipsr Provided. That no student shall be allowed to enter the College whose qualification is below the standard of the class to which he shall be assigned. Provision shall also be made for receiving students i'rbm any school, or other source, whose qualifications shall fit them for enter ing the classes to which admission is sought. Special students, who wish to pursue any particular branch, but who do not desire any degree, may be admitted under such terms as the Board shall regulate. 1'? Sec. 13. That the College shall not bo controlled to serve sectarian or po litical party interests, but shall be conducted for tho promotion of the general good of the State, as provided for in this Act, and the Act of Congress of which this is a part. Sec. 14. For the current expenditures of said College, certain sums of mon ey sluill be set aside in the hands oi the Treasurer by the Board of Trus tees, which shall be subject to the I warrants, of the Chairman of the Board, drawn in pursuance of the or der* of the Board of Trustees. All income resulting from labor, or other sources, shall be paid into the Treas ury of the College. All moneys due to the Institution, or received in its behalf, shall be collected and received by th3 Secretary, and deposited by h?m with the Treasurer of tho Slate Board of Trustees, taking his receipt therefor. Tho Secretary shall, with his annual report, render a full and complete account of all monej's re i-eh'ed, and .11 amounts drawn on the Treasurer by him as Secretary of th^ Board and shall file and preserve all vouches, receipts, correspondence, and other papers relatiu# thereto.
