TELE TRIAL JUSTICES ACT.
Two protests bftvc been pre
routed in the House Against tb
Trial Justices -Act, a synopsis o
which wo gavo in our last issue
The pvt)tests are signed by the lead
ing Democrats of that body, an<
let forth the vevy grave objection
founded upon the unconstitutional]
of the measure. It is shown to b
in violation of Section 21st of Arti
cle IY, which -provides that, "J
competent number of jusflces c
the peacc ana constctoies eiinu u
choscu, in cach county, by tli
qualified electors thereof, in sue
manner as the General Assotubl
may direct;" and also in direc
violation of. Article 8 of the Coi;
stitution, which makes the onl
provision for the removaj of an oifi
cer. According to the Constitution
fhere are only two ways in whicl
an ofllccr can be removed Iron

the other by the Governor, 0:1 tin

of the General Assembly, sU.tim

_j*cmoval is required: nn<l in al
eases the o/Iicer charged shall be
admitted to a hearing in his cwi:

The power of appoint mint a:i'i

. thus shown to bo plainly in derogation
of these clear provisions oi
the constitution. Jt confers upon

of tho*c objections the .Act was
j>ass<;<.!, and the Executive, to u^c
the language of Mr. Ihyant's protest,
now '-commands the militia,
controls the entire finances of the
Stato, appointing every ofiicer,
from State Auditor down to local
assessor; sets up and deposes, ac
cording to his own caprice, a very
largo nflinber of judicial officers of
the State ; and even solects the j?jymen
by whom tlie malfeasances
of his agents are to be tried.'1
There might be some excuse for
Republicans in Congress following
tlie new lights of 'the higher law,"
and setting aside an inst ument
which tliey regard as a rclic of "oM
fogyism," but v.iiat cotis>i-jtoney is
there in roi.ith Carolyn licynbiicans
knocking uown ilie idol
"which "their own hands have
made-?" If there bo a Constitution
in South Carolina, it is a lie
publican Constitution, ami embodies
all tho favorite dogmas of thc-ir
creed. If it be worth auy thing at
all, it is worth keeping. The Legislature
derives from it all- of its
legitimate powers. Any power
which it cxcrcisos beyond is revolu
tionary.

A CONFERENCE OF THE PRESS, OB
A CONVENTION OF THE PEOPLE.
Tiio Charleston News approves
tho suggestion of tho Guardian,
arid winch has been endorsed by
the Courier^ that there, bo a Conference
of ilio Tress of the State for
ir.e purpose ot discussing the political
situation, and securing harmony
of views, and concert of .action.
The Columbia Phanix suggests
a Convent von of the people,
mid so does also the Yorkville En,
quircr. ' In any point of view the
one would be but preliminary to the
other.- The action .of the Press
would only be advisory, that of the
Convention final and conclusive.
"Cpon certain points Vc are all
agreed?that we mnut ignore dead
issues, and address ourselves to a
living, active and progressive policy?that
we ranst concede civil and
political rights iu lurgest measure
to the black, man, and unite with
him if possible in electing houest
and capablc men to otlice. There
is however a difference of opinion
as to the policy of dropping old
party names and party organizations.
Upon the first point we
need neither Conference nor Convention
to secure harmony; would
they bo effective now, in reconciling
the differences of opinion,
which exists V
With due detenco to the opinion
of onr contemporaries, we thin:< it
prematnro ito attempt to adjust
differences now, by means of Press
