the validity of this provision under consideration
in the ease of the Union Bank of Tonnesane,
against Vaaderville.
The Court decided this requirement to be
unconstitutional.
They held that it was not necessary to the
validity of writs and other prooess in judicial
proceedings in the Courts of tho States, that
the Internal Revenue Stamps prescribed by tlie
Aot of Congress should be affixed to the writs
or process , that the Government of the United
Statss has not the constitutional powor to require
"stamps to be affixed to a process issued
by the State Courts.
It is a subject of interesting enquiry to asuoortain
how mnoh of the legislation during the
war, will stand the test of constitutional investigation.?Chat.

8tates, James Eagan, Esq., has been released
from arrest and restored to his friends It
will be remembered that Mr. Eagan, was cou-4
' dieted by a Military Commission of shocling
' negro in Lcxingtou District lost Summer,
and was sentenced to imprisonment for life in
the Albany (New York) Penitentiary. From
that Institution he was discharged by a decision
of Judge Nelson, of the Supreme Court of
the United States, obtained in a suit for a writ
'of Habetu Corpus, which was granted. Returning
home a few days since, he wus rearrested
by the military authorities of this State,
and confined in the jail of this city until his
a present release, which is final and absolute.

Davis' confinement is obviously a distinct
question from the legality of the persistent
tortures inflicted on him. Detention in custody
is a means of securing a prisoner uutil a
court can pass upon his guilt. Any severity
or tortnent not required for his silfe keeping
is not only unauthorized by law, but is a usurpation
of the functions of the jury and court.
It assumes bis guilt; but if guilt may be assumed
beforehand, the trial is a mockcty. It de
termines the nature of his puuishmeut; but the
Eunishment of all crimes is fixed by the law,
.must be declared, in each particular cn&?,
br the sentence of a Judge, and can he inflicted

The following is the estimate of the Assistant
Commissioner of Kreodmcn for the District
of Columbia of the amount of rations which it
will be necessary to distribute to freed men in
that District during the preseut month : Six
thousand full rations, pnyment for which will be
a ecu red by liens on rite crops; to employees
and laborers, 850, and ratio:.s to dependents,
22.000. Total, 29.350. This estimate includes
children slok in hospital, aged and infirm in
Alexandria, Fairfax and Loudon counties, and
Freedmen's village.
While a posse was bringing into Memphis,
two men, named 8. A. Payette and Frank
Wingate, arrested for the murder of Mr. Payne,
on Tuesday night, and who wero iuforuicd on
by Euback, an accomplice, they were met by
one Henderson, a relative of l'ayne, who shot

Tbe editor of the Montgomery Mail has been
shown several large nnd healthy cotton blooms,
from different plantations in that country ?
among them two very Hue ones from the plantations

Tobokto, C. W., June 21. ? The Legislature
of New Brunswick it is expected will adopt the
confederation scheme. Delegates from t'ana
da, New Brunswick, Nora Scotia, and New
foundland will probably leave for Kngland at
the end of tbe present month. The Knglish
parliament is expected to pass the necessary
aet at the present session in order to enable
the confederation of provinces to be completed
In August.
Several meteroio stones fell at Nnshville on
the 12th, near the railroad depot. They were
of a bluish color, and were quite hot when first
discovered. Geologist say that nothing similar
has been found in any part of the world. One
specimen has been forwarded to Washington,
another to New York, for further examination.
Joseph Eastcrbrook, Jr., of Camden, Maine*
got bis life insured for $3,000, and afterwards
became deranged and committed suicide by
shooting. The insurnnoe company refused to
pay lho polioy, but the Maine Supreme Court
decides that they must pay the $3,000 and the
costs besides.

above all social, civil and religious obligations.
It is more solemn and superior to Priest or

At the circuit court of Cape Qirardeau county,
Missouri, two Ministers, Rev. Mr. Munson
and Father Murphy, were indicted, tried, convicted,
and fined $500 each for the grave crime
of preaching the Gospel without having taken
the test oath of the new constitution.
The Supreme Court of Illinois, on an appeal,
has just rendered a decision that all gift enterprises
are simply lotteries, and the Distriot Attorney
is determined to drive them all from
Chicago.
It is stated that the census of HuntsviUe. (
Ala., which has recently been completed, chows
the total population of that place to be 4,621,
of which 2,273 are whites, and 2,248 blacks.
