It appears that the International Life Assurance Society, of London, having a loeal board and agency at New York, had, before the war, insured, at New York, the life of Mr. Maemurdo, domiciled at Richmond. Maemurdo, for a year before his death, whieh ocourred in 1801, during the war, paid hia premiums to the company's special agent, at Richmond, iu Confederate notes. The present action is to recover the amount Insured. The company defend, on tha ground that, as they were domiciled hero, and the poWey having been made and continued In tb}# SUte, and the agent having been appointed therein, the company were under the same legel obligations arising under the war as citizens.
