South Carolina Senator's Bill on
Futures?Calls For Standard
Grades.

Senator E. D. Smith of South
Carolina has introduced in the senate
a bill to provide for specific performance
of cotton contracts in interstate
commerce; that is, that
the contract shall provide the grade
to be delivered and that the vendor
must furnish that grade or a grade
one degree above or one degree below
it. The difference in price is to
be the actual commercial difference
between the values of the
grades on the day before the settlements.
This bill, if passed, will have the
effect of making every future contract
sale potentially a spot sale.
In that the purchaser can demand
and secure cotton of a grade which

employe, agent, owner or oflieer of
the above means of communciation
prohibited in this section who shall
knowingly use such property or
agencies of communication or
knowingly to allow such property to
be used for the transmission of any
message relating to such contracts
as are prohibited by the terms of
this act shall, upon conviction
therefore, be punished for such offense
by a fine of not more than
$1,000 nor less than $500; and the
Beading of each message in violation
of the provisions of this section
shall constitute a separate offense.
"Sec. 4. That any contract or
contracts for the future delivery of
cotton not having the specifications
herein enumerated shall be deemed
null and void; and any person, partnership,
Joint stock company, so-~ciety,
association or corporation,
their managers or officers, who shall
make or sell or attempt to sell any
contract or contracts for the future
delivery of cotton not conforming
to the provisions of this act or
shall fail to deliver in conformation
to the provisions of this act shall be
deemed, upon conviction, guilty of
a misdemeanor and sentenced to
imprisonment for three years or pay
a fine of $5,000 or both in the discretion
of the court; and provided,
further, that this act shall only apply
to interstate commerce."

The bill also provides for long
staple cottons. setting forth that
the length of such cotton shall be
stated in the contract and must be
approximated on delivery.
The bill denies the use of the
mails and other Interstate carrying
agencies to those who violate the ,
law, and further provides for a
fine.
The bill was read twice in the
senate and referred to the commit- 1
tee on agriculture.
The bill follows:
"That any person, partnership, '
Joint stock company, society, asso- l
elation or corporation, their man'
agers or officers engaged in Interstate
commerce, in making or offering
for sale any contract or con- I
tracts for the future delivery of I
cotton, shall snecifv the crude or I
grades contracted for in each and
every contract, and such grade as
Is, or grades as are, contracted for
shall he according to United States
government standardization; 'Provided,
That the seller of such contract
as is herein provided for may
have the option of delivering in settlement
of such contract not more
than one grade above or one grade
below such grade as in contracted
for. And the settlement of the difference
between the price of the
grade contracted for and the grade
delivered shall be the actual commercial
difference In the price of
such grades on the day previous to
the settlement of such contract.
And it shall be the duty of the secretary
of agriculture to standardize
the grades of 'uplands' and gulf
cottons separately; and such grades
as are established for both 'upland'
and 'gulf' cottons shall not be
below good ordinary or above middling
fair. It shall be the duty of
the secretary of agriculture also to
standardize according to grades,
stains and tinges. |
"Sec. 2. That In case long staple
cottons are bought or sold for future
delivery the length of the
staple shall be designated in the
contract, and the cotton shall be,
when delivered, delivered as of the
grade and length of staple designated
in the contract.
"Sec. 3. That the use of the
mails, telegraphs, express companies
or any other method of interstate
communication shall be denied
any person, partnership, joint
stock company, society, association,
corporation, their manager or ollicers
or employes in making such
contracts not conforming to the pro**
visions of this act. and that anv
