. ®ie (Bamccock Napster offers $1 billion settlement if record companies drop lawsuit by Ron Harris Associated Press SAN FRANCISCO (AP) - Napster Inc. offered $1 billion to major and independent record labels Tuesday in hopes of getting them to drop a copyright infringement lawsuit that threatens to shut down the free Internet song-swapping service. Under the proposal, $160 million would be paid annually for the first five years to Sony, Warner, BMC, EMI and Universal, with an additional $50 million allotted annually for independent labels. Napster chief executive Hank Barry said it was important to reach a deal. “We all ought to sit down and settle this case as fast as we can,” he said. “Wfe’re saying this is something consumers really want. Let’s do something to keep it going.” The offer was announced a week after a federal appeals court said the music industry almost certainly will win its lawsuit against the pioneering digital entertainment company. A three-judge panel of the 9th US. Circuit Court of Appeals ordered FANNING Napster to stop millions of users from swapping copyrighted music without charge or restriction. Napster, whose lawyers have said such action would be virtually impossible, has vowed to appeal. Napster has argued it isn’t to blame for how subscribers use copyrighted material, citing a 1984 case in which the Supreme Court refused to hold VCR manufacturers and videotape retailers liable for people copying movies. But the appeals court said no such protection extends to Napster because the company knew users were swapping copyrighted songs. The panel also said there was evidence of “massive, unauthorized downloading and uploading of plaintiffs’ copyrighted works — as many as 10,000 files per second by defendant’s own admission.” Napster’s popularity exploded in 1999 after founder Shawn Fanning released software that made it easy for personal computer users to locate and trade songs stored as computer files in the mp3 format, which compresses digital recordings without sacrificing quality. - The five laigest record labels sued as soon as Napster took off, saying it could rob them of billions of dollars in profits. Napster did reach an agreement with former foe Bertelsmann Inc., the parent company of the BMG music unit. The German media giant has promised much-needed capital if Napster switches to a subscription-based service that pays artists’ royalties. Bertelsmann executives were at the news conference Tuesday at which the Napster offer was revealed. Jon Stewart to take over as Grammy host by Lynn Elber Associated Press LOS ANGELES (AP) — Jon Stewart was almost ready for his close-up as Grammy host. He just needed to scribble a few jokes to perform in front of several million viewers. The comedian and actor was bravely stepping in at the last minute to emcee Wednesday’s awards show after Whoopi Goldberg canceled because of illness. Goldberg bowed out several weeks ago, and Grammy officials delayed naming a replacement until this past week. They wanted the controversy over rapper Eminem’s performance to quiet down a bit so Stewart would get the attention he deserved, a Grammy spokeswoman said. “Yeah, that’s why, they didn’t want to steal my thunder. Good theory,” said the reliably sardonic Stewart. So why did Stewart, host of Comedy Central’s The Daily Show, agree to take the job? “You opening up a new IHOP restaurant? I’ll be there,” Stewart joked. “I’m doing it because, quite frankly, when they blow through so many big show business names to get to-you, they’re so distraught, you feel like you’re on a suicide hot line.” Though he had little time to write Grammy material, Stewart seemed unfazed Tuesday. “I know what I don’t do to get ready. They’ve locked my hotel minibar, and they won’t let me in it. And I told them I just want the Toblerone candy. I don’t want the little bottles of (liquor).” The show, which is airing 8 p.m. Wednesday on CBS, has a momentum of its own, Stewart said. “These are 16 brilliant musical acts. The chef has baked a delicious cake; I’m just trying not to get a hair in it.... If you can get in a couple of funny things and kind of hold the show together with a nice tone, then 1 think people will be pleased.” Eminem is expected to be a central figure Wednesday. He won two Grammys this past year, and this year was nominated for the prestigious album of the year award and in three rap categories. Eminem’s planned appearance with Elton John has drawn criticism from gay rights groups and others upset by the controversial rapper’s anti-homosexual and anti-female lyrics. “I think they’re sincere about being upset with that, and they’ve got a right to be upset. Apparently, some of the stuff [Eminem] says is incredibly vituperative,” Stewart said. The thorny issue won’t keep Stewart from cracking wise, will it? “Wait a minute, I’m supposed to be doing music jokes? The Clothesline Project provides an opportunity for female survivors of violence to paint a t-shirt expressing their inner sorrows and triumphs. These t-shirts are then displayed on Greene Street during Women’s History Month so that others can bear witness to the survivor’s experience. T-Shirts are color-coded in order to recognize the uniqueness of each Clothesline Participant’s violent encounter. White for those who have died from violence Yellow for those who have been battered/assaulted Pink for those who have been sexually assaulted Blue for survivors of incest or child sexual abuse Purple for those attacked because of their sexual orientation How can I Participate?
