A resolution denouncing the use of the term "damn niggers"
by a retired chief justice sitting as a special circuit judge
awaits consideration by the South Carolina House.
The measure, which received a favorable report from the
chamber's Invitations and Memorial Resolutions Coimmittee,
was introduced Wednesday by three black Richland County
House members.
Rep. Robert Woods, D-Charleston, asked the House today
a to give the resolution immediate consideration, but several
^ lawmakers objected, and discussion was postponed until at
least next week.

remark made by Moss while he sat as special judge in Anderson
County last week.
"These remarks, if quoted and attributed accurately constitute,
at best a disregard of the heritage of many citizens of
our state," the proposed resolution said.
"ALTHOUGH THKRK arc appropriate judicial commissions
and appellate procedures to determine the appropriateness
of these remarks as they impact upon the
judicial process, the General Assembly . . .is desirous of
publicly stating it docs not condone this type of language at
any time and especially when used by our state's judicial officials,
and . . .it hopes and expects the judicial matters of this
state to be conducted in the future on a higher plane," the proposed
measure added.

Moss, 81, has worked as a special judge sincc his retirement
to hold down the backlog of cases in various circuits. He exnrcssed
snrnrise that anvonc would be unset about the remark.

The former chief justice used the term Jan. 16 in reference
to a group of blacks upset by the conviction of Hobby Ray
Harrison, a black, on charges of shooting a white Pendleton
teacher Oct. 30.
Because the judge's microphone was turned on at the time,
his remark was heard by several people in the courtroom and
recorded in the official record by the court stenographer.
NO FORMAL complaints over Moss' remark had been filed
with the Supreme Court earlier this week, Chief Justice C.
Bruce I.ittlcjohn said.
But McBridc said several citizens have expressed dismay at
the remark and asked what could be done.
"I think it (the resolution) has a very good chance of passing,"
he said. "But we'll have a fight on the House floor; I'm
sure of that."
