The 9th U.S. Circuit Court of Appeal
handed the Raiders a significant victor
earlier this week, ruling 2-1 that the NFS
violated antitrust laws by conspiring to pre
vent the Raiders from moving to Lc

power to block any future franchise moves

ourt decision
il Commissioner Pete Rozelle's office. "The
i\ league also believes it should be able, in makls
ing such decisions, to respect the loyalty of
e fans and communities that supported its
>s franchises as well as Oakland did."
Rozelle's statement said the 2-1 split "cmIs
phasizes the need for Supreme Court
y clarification of the fundamental question of
L how the antitrust laws should be applied to
sports league."
is The ruling did not address the $48 million
o in damages that a Los Angeles jury awarded
the Raiders' and the Los Angeles Coliseum,
e The court said it would rule later on that.
The three-judge panel said the lower court
?- had correctly applied federal antitrust laws
A and the six-woman jury had sufficient
evidence to decide that the NFL had cone
spired to restrain trade in its attempt to block
e the Raiders' move to Los Ancclpc
is "We believe antitrust principles are siiffin
ciently flexible to account for the NFL's strui,
cture," the court said.
f The NFL contended on appeal that it is a
t single entity rather than 28 franchises, and as
y such is not subject to U.S. antitrust law.
e
But the court said part of the NFL bylaws
i is, on its face, an agreement to control, if not
s prevent, competition among the NFL teams
e through territorial divisions.
