Court mav rf
(AP)?It's now up to the state
Supreme Court to decide whether convicted
murderer Louise Whitted
should be tried again for the 1981 slaying
of her husband.
Whitted's attorneys told the high
court Monday that her grand jury
hearing was a "rubber stamp" procedure
and made legal challenges of
other areas of the case.
The Supreme Court usually takes six
weeks after oral arguments before issuing
a ruling on an appeal.
Whitted, a former beauty queen,
was convicted in February 1982 of
murdering Charles Edward "Bill"
Whitted while he slept at their home
near Travelers Rest. She is serving a
life sentence.

daughter Kathy. Instead, Henry contended,
the jury received "hearsay"
evidence from the prosecution.
"The defendant needs to learn if a
fair and impartial grand jury proceeding
was held," Henry argued. He
said such proceedings and their
transcripts are traditionally cloaked in
secrecy in Greenville County.
Henry cited a previous state
Supreme Court ruling holding that
grand juries are entitled to hear more
than the prosecuting officer's version
of a case. In Whitted's case, her
lawyers contended, the grand jury only
heard from sheriff's investigator Bill
Hitchins.

Adams countered that all grand jury
proceedings are legally sealed against
divulgence and asserted that secrecy is
a fundamental principal of the
proceeding.
In the Whitted case. Hitchins'
testimony was not all hearsay
testimony, Adams said.
Whitted's daughter Kathy and her
daughter's boyfriend, Chris Anderson,
also were charged in the slaying. Kathy
Whitted was convicted of conspiracy
and accessory before the fact of
murder and sentenced in Family
Court.
Her sentence, as well as Anderson's,
are to be completed this year, Taylor
said. Anderson, who was a central
witness for the prosecution in Whitted's
trial, pleaded guilty in Family
Court to murder.
