Licenser recaps rejects
HOUSTON (AP) ? Of the thousands of driver's license ap
plicants flunked by Jim Alexander, one failure stands out ? s
prospective bus driver who flattened a parked pickup truck,
"He just looked at that pickup," said Alexander, a troope
with the Texas Department of Public Safety. "He didn't hav<
much to say."
Alexander, who has been testing applicants since 1967, said hi
can now sense when some people aren't quite ready to drive,

worrying about my safety. I've jumped out of a few cars over th<
years when the drivers forgot about their clutches."
Another time, a driver he was testing came within a split secon<
of causing a pileup on Interstate 45.
"I finally got her stopped on the shoulder and she was alread;
crying," he said. "I preferred to walk back to the office, and
was proud to have the chance. She just wanted to sit in the car an<
crv until someone from her family came and drove her home."

Ross' ruling overturned decisions by
local and state hearing officers.
Lawyers for the district argued
Wednesday that it met federal requirements
when it educated Dunn in the
public schools even though the private
program may have been superior.
"If what the school offers confers
benehts, it doesn t nave to pay tor a
residential program just because it's better,"
said Dean Rainey, a lawyer for the
school system.
Rainey also argued that federal law
does not require the school to offer services
that will "cure" a handicapped student's
problems.

Rainey said achievement test scores ^
showed the teen-ager, who has average
intelligence, improved considerably after
his last full year in a public school program
during 1980-81. His parents have
since put him in a private school.
However, William Ehlies, Dunn's
lawyer, argued the case involved the facts
of his progress, not just a legal question
of the school's responsibility.
Dunn improved his skills by only one
grade level between 1975 and 1981, the g
lawyer said.4'That's a meaningful educa
