Weaver Gamecock Staff Writer A second USC faculty member denied tonure and then reinstated by the State Employee Grievance Committee said he has not ruled out the possibility of filing a libel suit against the university. Philip M. Zeltner, an assistant professor of philosophy, was told his job would be terminated at the end of this semester. The grievance committee, however, said USC dismissed Zeltner without proper cause and without evaluating his job performance. The 33-year-old professor, who received the 1978 AMOCO Outstanding Teacher Award, said he doesn't believe the case is over and that USC will continue to take uuuuii against nc onu uuicia gumg through the state tenure system. "IF I'M put out of my job, I'll have no cnoice but to try and recoup my damages, because I would have lost my job unfairly. USC history professor Michael Smith was the first to successfully appeal his dismissal through the state tenure system. He had been terminated as of Dec. 31,1979, but was ordered reinstated by the greivance committee as of Jan. 1, 1980, on the same grounds as Zeltner. THE DECISION concerning Zpltner is Dart of an on-going dispute between USC and various state agencies about who should be the ultimate authority over job decisions involving university faculty. The grievance committee, acting under the authority of the state Budget and Control Board, has the power to reverse any order of the university pertaining to employment matters. USC has filed a suit asking for an order exempting faculty members from State Personnel Division regulations and barring them from appealing dismissals in the state grievance procedure. In the suit, USC contends that non-professionals do not have the experience necessary to evaluate a faculty member's performance as well as his peers can. FRANCIS BORKOWSKI, USC provost, said the Zeltner decision "was not unexpected. The basis for the reinstatement is the same used in other grievance cases, so it was certainly not unexpected." The reinstatement action of the grievance committee further complicates university tenure procedures, Borkowski said.
