The Department of Health.
Education and Welfare has
rejected the alternative Sanford
Plan to Title IX which would allow
universities to allocate athletic
funds according to their own needs
in a non-discriminatory manner.
However, HEW has incorporated
the main provisions of the alternative
plan.
HEW allows no sex
discrimination in educational and
athletic programs. Title IX
regulations require each
university to give its women's

as it does its men's programs.
The Sanford Plan, endorsed by
USC President James B.
Holderman, was compiled by a
coalition of colleges and universities
to allow individual institutions
to determine compliance
with Title IX.
HEW PUBLISHED a proposed
policy interpretation Dec. 11, 1978,
and received more than 700
comments and recommendations
in response. Department officials
then met with many colleges and
university officials, including
athletic associations, athletic
directors and woman's richfe
organizations.
HEW representatives visited
eight universities during June and
July 1979, checking how the
proposed policy and other alternatives
would work in actual
practice at individual campuses.
The final policy interpretations
are a composite of the comments
HEW received and the results of
the campus visits.
The major changes to the
proposed policy interpretations of
December 1979 took place in the
general format. The proposed
form was based on a two-part
approach. Part I called for equal
opportunity for athletic programs'
participants. A school would have
been in compliance if the average
per capita funding for both female
and male athletics was fairly equal
in the area of financial benefits and
opportunities and if the benefits
and opportunities not financially
measurable were comparable.
PART II required an institution
to develop its women's athletic
program, broaden participation
and competition opportunities and
demonstrate equal accommodation
of athletic interests
and abilities of women and men.
The final policy interpretation
makes no separate mention of an
instituion's future responsibilities.
Usually, these involve the
development of athletic programs
with substantially expanded opportunities
for women in participation
and competition at all
levels.
The reasons for the changes
included the need for clear
guidance on what constituted

therefore, decided that stating
actual compliance factors would
be better for all concerned. A
purely financial measure was not
conclusive of discrimination,
except in the case of a scholarship
where the nature of the benefit
under review was financial.

institution's compliance with the
equal opportunity requirements of
the Title IX regulations. When a
recipient of federal aid is found in
noncompliance, and voluntary
compliance attempts are unsuccessful,
procedures will be
started to stop assistance.
The main thesis of the proposed
Sanford Plan included in the final
policy interpretations is selfassessment
and institutional
planning. Each institution would
be able to apply and plan what is
right for it and its own athletic
program. Any institution participating
in the assessment and
planning process would reach or
move toward full compliance.
Also, any institution having
problems complying but is implementing
a plan found acceptable
by the department will be
found in compliance.
