The meeting was scheduled in
public session. Shortly after the
meeting began, board chairman,
R. Markley Dennis called it into
executive session and closed it to
the public.
AT THE CONCLUSION of the
meeting, Dennis said no formal
action had been taken in the
special session. However, two
days later, he stated that formal
action had in fact been taken, and
the USC coaches had been informed
of the board's decisions,
according to the complaint.

Richland County representative
Jean Toal, who is
representing the plaintiffs in the
matter, said the board and
Dennis are in direct violation of
the act. "They (Cooper and
Wingate) are asking the court to
halt the action of the Board or
Trustees on September 4 until it
is done in compliance with the
S.C. Freedom of Information
Act," she said. i
"They want it declared null and
void until an open and public
meeting is held to ratify or reject
their decision," Toal added.
THE ACT REQUIRES that a
public body vote in public upon
the question of whether to hold a
meeting closed to the public. I
This section further requires
that the purpose of the executive
session be announced to tne
public when the public body voted
favorably on a motion to meet in
closed session. It also requires
that any formal action taken in
executive session shall thereafter
be ratified in public session prior
to such action becoming efk>

"I don't feel that I'm in
violation of the Freedom of Information
Act," Dennis said.

talking about negotiation. No
final action was taken."

Activities Committee,
chairman Hugh H. Wills

THE BOARD MEMBER said
that although three of the five
members supported the announcing
of the decision, a

overruled them.
