David L. Rosmer's attempt to
gain monetary restitution for his
recent Student Government
Association (SGA) election
campaign was dropped because of
the Student Court's inability to
award monies for personal
damages.
"There is no mechanism for
asking the Student Court for
money," Robert Jendrom, student
Legal Aid supervisor, said "and
there is nothing in the South
Carolina Code of Law that allows
the University to assess money
damages."
Rosmer had attempted to seek
punitive damages of $615 through
the USC court system after the
SGA primary elections were
postponed March 4. He had
estimated his campaign cost $115
in advertising and $500 in time
spent on the campaign.
Section 7, paragraph C, number
4c and d of the Student Conduct
Code states that "penalities mainly
administered by existing
Residence Courts" include "order

student has engaged in conduct
injurious to property of another
(individual, group, or University)

"Dave (Rosmer) understood
that if he was to seek any money
that we would have to go outside
the University to the state court,"
Jendrom said. "From that point
it's out of our (Student Legal Aid)
hands because he didn't qualify for
our indigency program."
"Even though I dropped my suit
I feel that it raised a good point,"
Rosmer said. "It made the
students realize that these guys
(SGA officials) are getting paid a
salary and have a job to carry out
for the University and the students.
There was about $4,500 wasted in
that election and it was the
students' money. I feel that the
suit impressed upon the students

Rosmer illustrated the situation
with a hypothetical case:
"With about 20,000 voters in the
USC community, that . is about
equivalent to the amount of voters
in a town like Sumter. If the
government of Sumter was as
inefficient as SGA was in running
the elections, then there would
have definitely been criminal
action brought about.
"For my own personal reasons I
felt that the case did not need to go
the State Court," Rosmer said.
