A suit charging the
University insurance plan with
fraud has become bogged down
in legal technicalities and trial
delays.
In April a lawyer
representing insurance agent
Joe Pearce and Reliance In
surance Co. said, "I think this
suit will be resolved on its
merits and not technicalities."
Now that same firm is arguing
the class action suit, filed by
USC law student George
Frooks, does not constitute a
true class.
Timothy Cleveland,
representative for Frooks'
lawyers, said Pearce and the
insurance company are
arguing there is a "defect in

Frooks is suing individually
and on the behalf of all
university students with the

Cleveland said the class

The attorney general will only

The controversy began last
spring when Frooks went to the
infirmary after hurting his
hand playing volleyball. He
had purchased the $25 student
hospitalization insurance at
registration and assumed it
would pay his infirmary bill.
He was shocked to find the
policy did not pay for any
service rendered by the
Student Health Center and
decided to investigate why.
