Before a quorum call cut
short Wednesday night's
student senate session, a
resolution was introduced
calling for a censure of
District III court for "over
stepping its authority in
respect to the student
government fall elections."
This was the latest
development in a long string
of events surrounding the fall
elections.
The first dispute arose when
three students petitioned the
USC Supreme Court to enjoin
the elections for several
reasons, filing time was
inadequate, proper notice was
not given to the student body,
and procedures for collection
of funds did not comply with
regulations.
In turn, the court dismissed
the petition for its lack of
jurisdiction in the matter and
sent it to District III Court.
The petition was sent to
district III presumably
because one of the petitioners
was from that district.
District III enjoined the entire
election and held a hearing.
This is the first point the
censure resolution takes issue
with: does District III Court
have the authority to enjoin
elections outside of its
jurisdiction?
During the hearing
arguments were heard from
the petitioners from both

district III and district II. This
is the second issue raised;
does district III have the
authority to hear petitioners
from other districts?
Also, during the hearing, an
elections commission
member, besides the chair
man, was not allowed to stay
during testimony. This is the
third issue taken up in the
resolution.
After the hearing, the court
ruled by word of mouth that
the elections would be held
October fourth instead of the
original date. Because no
official written instructions to
that effect were issued, the
elections commission went
ahead with plans for the
election to be held on Sep
tember 27. At the last
moment, the elections were
cancelled by the commission.
