PROCEDURE FOR APPEAL CASES SHOWN REVISED Section Ten Has Been Revised to Allow Three Preemp tory Challenges LAW SENIOR TO PRESIDE Rules of Procedure for Appeal Cases to Be Adopted by Student Body 1. Upon the receipt of a notice of appeal from a decision of the Honor Committee, the President of the Stu dent Body shall set a suitable time for the trial of the appeal as soon there after as in his judgment the trial may be conveniently held. 2. After setting the time, the Presi dent of the Student Body shall post notice upon the bulletin board and shall have such notice read at chapel for two days preceding the trial. 3. The president of the student body shall call a meeting of the student council for the purpose of drawing a panel of forty-five (45) student names which number shall be three times the number of those who shall constitute the trial jury. 4. This panel shall be drawn by plac ing the names of all students duly en rolled in the University, except that of the appellant and members of the honor committee, in a common receptacle and after thoroughly stirring up the papers containing the names, drawing out the required number. In the event the hearing is set within one month after the beginning of any semester, the names of those students only who were enrolled during the preceding semester and are still enrolled shall be placed in the common receptacle. 5. The student council shall notify those drawn of the fact in writing which writing shall point out to them the fact that their duty to the Univer sity both require them to be present at the trial and to refrain from discussing the case with any one pending the trial, in the event they should in any manner hear the names of the appellant or any of the circumstances connected with the case. 6. At the time set for the hearing, the president of the student body shall preside and announce the purpose of the meeting and then turn the conduct of the appeal over to some senior law student previously chosen for this pur pose by the president of the student body with the approval of a majority of the student council. 7. The appellant and honor com mittee shall take seats on the rostrum or some other suitable place. 8. The appellant and the honor com mittee shall have the privilege of being represented by one student each as at torney. 9. The panel previously referred to shall be presented to the presiding of ficer, who shall in the presence of the student body, draw out the required number to constitute the jury. 10. Each may have three preemptory challenges and in addition may chal lenge for cause but only the following reasons shall be considered cause: a() Juror is a witness. (b) Juror is attorney in the case. c) Juror is related within the fourth degree to either the ap pellant or any nmember of the honor committee. (d) Juror is room-mate of the ap pellant. 11. If by reason of absence of be cause of elimination by challenge, it be comes necessary to draw additional names from panel, the presiding officer shall do so until a sufficient number to constitute the jury has been chosen. 12. In the event the entire panel should be exhausted without getting a jury, the presiding officer shall have all students present write their names on a slip of paper, and form these slips draw a sufficient number to make up the jury. 13. The appellant in person or by his attorney shall then state his grounds of appeal and then the honor commit tees side of the case shall be presented. followed by the appellant's side, after which the honor committee may intro duce evidence in rebuttal. 14. In placing before the jury the facts on which the findings of the hon University Men on ' Teacher's Program On the program of the convention of the South Carolina teachers associa tion are three University men: Dr. Pat terson Wardlaw, speaking on "How may we broaden the field of adult edu cation?" and Dr. B. L. Parkinson, speaking on "Professional preparation of commercial teachers." Othe mem bers of the University faculty who are to speak are Professor Orin F. Crow, Dr. E. L. Green, and Miss Irene Dil lard, dean of women. This convention is to be held in Greenville, March 24, 25 and 26, meet ing away ftom Columbia for the first time since 1920. Most of the faculty of the school of Education will be among the 5,000 members expected. It is said that an effort will be made by the Columbia Chamber of Com merce to bring the convention back to Columbia next year. The main reason for the change is that there was no building in Columbia large enough to serve as a headquarters. However, the new field house of the University has a capactity of 5,000, and the chances are that the next meeting will be held here. sons for taking the action taken, and also in placing the case of the appel lant before the . jury, strict rules of evidence are not to be followed, but the presiding officer shall admit any evidence or statement which in his opinion may tend to clarify the situa tion and aid the jury in coming to a just and proper decision of the appeal. This rule is not to be construed as pro hibiting the presiding officer from rul ing out anything which he thinks ir revelant or redundant. 15. No character witnesses either for or against the appellant shall be heard. 16. The attorneys for the two sides, or should the privilege of having an at torney be waived, then the principals themselves, shall have the right of cross-examination. 17. The presiding officer in his discre tion, shall permit questions by mem bers of the jury. 18. The attorneys, or the principals in the absence of attorneys, shall then be permitted to sum up the evidence in addresses to the jury. But emotional appeals shall be considered contrary to the spirit of the honor principle. The length of tlese addresses shall be de termined in advance by the presiding officer after consulting the wishes of the two sides, but in no case may the presiding officer allow more than twen ty-five (25) minutes per side, nor may he deny ten (10) minutes per side. The appellant shall have the right to open and close, but he must so divide his time that the close shall not exceed five (5) minutes. 19. At the close of the address, the presiding officer shall instruct the jury to retire and bring in a verdict. The majority shall rule. The material was sent to the Observer Printing House, Inc., Charlotte, N. C. The engraving of decorative designs and borders is tcing done by the Bush Krebs Co., Louisville, Ky. One part of the artistic work which will be of much interest to the students is that part - which is done by -the members of the University department of design and painting. The artists of the University made twenty-eight drawings for chap ter sub-division headings. These draw ings were done with pen, brush, and ink. The Garnet and Black this year will be the largest that has ever been put out. It will have 396 pages, 30 pages of which will consis: of sponsors of the various classes, clubs, and societies of the campus. Notice has been given that all orders for the Garnet and Black must be in not later than Saturday, March 19th. It is important that this be done now as six or eight weeks must be allowed for the manufacture of covers, which must all b'e made at one time. -U.S.c.
