SOME MISUNDERSTANDING
There seems to be some misunder
standing as to the object and functions
of the Student Government and Student
Council.
When the committee that was first ap
pointed to petition the faculty about a
vigilance committee went before the fac
ulty, or representatives, of the faculty,
they were not in favor of a com
mittee to see that freshmen should wear
their caps but after an elaborate dis
cussion it was finally decided that if the
sttdent body wished to handle all the
affairs pretaining to student conduct the
faculty was heartily in favor of such a
Ilan. The Student% Body! Committee
was then instructed to draw up such a
lan and submit it to the student body
for approval.
Five years ago Carolina was laughed
at, scorned and criticized. Within the
last two years she has blotted out that
stain to a large extent. At present she
is not looked ppon as a school where
tea-hotads, drunkards and gamblers
dwell, but instead she is looked upon
as a school with high ideals and a strong
morals. Yet there is room for improve
ment.
You ask, "What is wrong with the
present system?" As far as the faculty
is concerned they could not handle it
better under existing conditions. The
argument for this change is, however,
that one nightwatchman cannot handle
seven hundred students and see that
all of them are conducting themselves
as they should. The object of this sys
ten i4 not to ship anybody for the love
of it, but rather to help such men as
would be brought before them and cor
rect their mistakes. If a man should
appear before this committee, it would
be their duty to do all in their power
to help him over-come his error, then
if he should deliberately disgrace the
niame of Carolina, it would be their duty
to restrain him.
Some have the idea that every student
will be under obligations to report him
lelf or any other for anything that ap
ears to be wrong. As the writer un
lerstands it, no man will be under any
nore obligations to report to this com
nittee any other man than he is at the
present time. It will be the duty of
this committee to summon the man or
men that are violating the code and give
him a fair and square trial. Then if he
feels that he has not had a fair trial,
he can appeal to the Student Body.
Now, the whole thing comes to this
moint. When a person matuculates at
the University of S. C., he is considered
I man or woman and not a high school
ttident who must be controlled by po
ice or some form of discipline. Are the
students of Carolina nioi able to con
rol and govern themselves? If not, I
ay a sad day has come.
At present, there are a number of
roups and classes on the campus that

rothers and sisters and are to stand

Everyone has a right to his ownt opin
ion, but no one has a right to anything
called opinion unless that be based upon
exhaustive study, minute examination,
calm and sober reflection. The Student
Body has been called together and ask
ed to consider certain changes in the gov
ernment of that body. The object of
this article is to advance a possible solu
tion of the evils now attributed to the
present System and to stimulate intel
ligent discussion of the question through
tile columns of the GAMECOCK.
It has been suggested that tile Student
Body enact a code of Laws,-or adopt
a constitution embracing "statutory law"
and setting out distinctly the Cannons
of Conduct for the Studeits;-the which
suggests to my mind the ancient question
of whether the Civil Law of Continen
tal Europe or the Common Law of Eng
land is the better system. Let it be here
said that our traditions, customs and
laws, generally, are based upon the Com
ion Law of England and that it is the
foundation of Americai culture. Also,
that throughout the world wherever the
Common Law has come in conflict with
thd Civil Law it has conquered and dis
placed its mighty rival ; not the greatest
cause for which has been this remarka
ble distinction:-Under a code,-which
is always subject to unholy annihilation
by being "construed" to mean something
entirely different from the original leg
islative intent, one cannot be held ameid
able to restraint or correction unless
the Code names the offense, whereas, un
der the Common Law, the test is, not
what has been adjudged wrong, not some
conduct which was punished and a record
made of tile offense, but what miyht have
beei the subject of correction and res
traint in tile right of our conception
of good morals. From which you will
readily perceive that under the Common
Law, where one is guilty of a gross in
fraction of the rules of common proprie
ty he is subject to restraint regardless
of whether there be a statute upon the
subject or not. How many average fami
lies in South Carolina today have a con
stitution or Code of Laws for the mal
agement of the home? What member
of an average family who has reached
tile age of discretion but knows full well
what conduct is expected of him? The
attributes of a gentleman are inculcated
in every student at Carolina long before
he enters here. His innate sense of pro
priety, his own conscience, tells him
what le should db and what iot. Igno
rance is no excuse!

wish to change the one already submit
ted, the committee will gladly consider
your proposal. The school is growing
Why not grow with it?, Cannot the sen
