LAW DEPARTMENT M. R. Reese, Editor The regular weekly ineeting of the Moot Court was held in the law building last Thursday night, February 25. The ease for consideration was that of John Ridden vs Columbia St. Ry. and Elec. Co. It was an appeal case argued before the Supreme Court, which was composed of W. H. Hartz, C. J. and M. R. McCown, A. J. The attorneys for the defen dant-appellant were Messrs. Din kins"and Barre, while those for the. plaintiff-respondent were Messrs. Sanders and Reese. Associate Justice McCown ren dered the decision of the court, Chief Justice IHartz concurring. The case was affirmed for the plaintiff-respondent. The decis ion of the court is, in part, as follows: "This case comes to us from t ie Court of Common Pleas for Richland County, in which judgment was rendered for the plaintiff in the sum of $5,000. From this judgment the defen dant appeals. The one exception urged by the appellant is that His Honor erred in failing to charge to the jury one of the re quests submitted, viz: 'That the plaintiff in remaining on the plat form of the car when there was plenty of room inside, was guilty of contributory negligence, and could not recover.' "In this case, for the trial judge to have charged the pro position contended by the appel lant, the plaintiff would have been non-suited. We cannot agree that as a matter of law that the riding on the rear plat form of a car would amount to contributory negligence. There must have been some other overt act on the part of the plaintiff shown that would have amounted to a lack of due care. We therefore sustain the trial Judge in submitting the case to the jury to determine whether or not the plaintiff by his contribu tory negligence was responsible for his injury. This finding of the jury we will not disturb and the verdict of the Court of Com mon Pleas is affirmed." New Chapel Seats. The Gamecocks went down ih lefeat before the Wofford Ter riers Monday night. Carolina worked hard and had the lead in the first half of the game, but the rerriera 'bistled up in the second half and made a wild dash for vic tory. The game ended with the Did Gold and Black leading 28 to 14. The Gamecocks made a noble effort in spite of their lose. Bowen and Danner wereCaroli na's stars. Patterson, Anderson, indCollins played best for Wof ford. Although Bowen is playing for the first time itf college ball, he is the star player of the team. The members of the third and fourth year Greek and Latin :lasses have formed the Classical 3ociety, the purpose of which is to spread the knowledge of Greek and Roman civilization. The so .lety will meet the last Thursday in each month and discuss Greek and Roman art and literature. The first meeting was held rhursday of this week at the home of Dr. Green, who is the promoter of the study group. The topics under discussion Thursday wening were "The Roman The 4tre" and "The Derivation of the giames of North African Coun tries." The following are the men who were present at the first meeting: Jim Fdmunds, "Bub" Langston, Charlie Ed wards, H. C. Brearley, H. 0. Ranna, and M. M. Weinberg. Sandwiches and cocoa were served. There was also a mix ture of candy spread before the literateurs. This promises to be mne of the most interesting clubs n the campus. Dan Crider was operated on LRriday morning for appendicitis. rho operation was particularly serious, for his appendix had burst before the operation. The peration was successful, but 3rider is very sick due to the ate operation. All wish him m speedy recovery.
