Circular Xo. 10. issued from the
Comptroller Ceueral's oflice to-day,
and addressed to County Auditors,
reads as follows:
Where County Boards of Equalization
have reduced the valuation of the
property of any individual, company
or corporation, and did not apportion
the amount so reduced to the valuation
of the property of other individuals,
coninaiiies or corporations of their re
speetive Counties. Auditors are instructed
to disregard the action of
such Boards, and to enter the property
of such individual, company or corporation
upon their duplicates at the
"true value in money."
Section 2->l, rule 3, General Statues,
prohibits County Boards from reducing
"the aggregate value of real and
personal property of the County below
the aggregate value thereof as returned
by the County Auditor."
The provisions of Section 229, prohibiting
County Auditors from increasing
the returns as made by taxpayer,
his or her agent, except by
authority of the Board of Assessors,
is meant to prevent the arbitrary ex|
erci*e of power without notice "to the
taxpayer through spite, spleen or prejudice
in thus cutting otFappeal.
Section 239 of this chapter makes it
