The recent decision of the United
States Supreme Court touching the
constitutionality of the Civil Bights
legislation, published elsewhere, is of
no little moment to the entire South
ern people. It should be remembered,
however, that the decision of the Court
in effect renders null and void only
the legislation by Congress upon the
subject, and does not affect in any
way whatever similar statutes passed
by the different State Legislatures.
So, after all, these are matters that tin*

The trial of O’Donncl for the mur
der of James Carey, the informer, has
been postponed till the 21st of Novem
ber. The postponement was on the
motion of the defendant's counsel and
for the purpose of giving lime for the
arrival of the great criminal lawyer,
Charles Russel, of counsel for the pris
oner, and a number of witnesses sum
moned for the defence. Gen. Roger
A. Pryor, American counsel for
O’Donnel, will figure prominently in
the trial of the case, and it will be all
in tjll one of the most cxcitimr and in-
cluigrined and disappointed Republi
cans to explain away the flogging they
received at tbc hands of Hoadly and
his crew a few days ago. Gas as much

Tins newly elccled Legislature of Ohio
will elect his successor, and that ques
tion is now being warmly agitated in
Democratic circles in that State. Pen
dleton js himself a candidate for rc-
clection, and it is rumored that the
venerable Thurman has his eye upon
tho coveted prize. The latter while in
that body stood head and shoulders
above all of his Democratic colleagues,
both as a lawyer apd statesman, and it
is earnestly hoped, both for tho good
6f the party and the well-being of # the
nftic-f', that the Ohio Legislature will
honor itself by tendering the election
to cx-Seuator Allan G. Thurman.
The Civil Rights Act recently de
clared unconstitutional by the Supreme
Cdurt of the United States, was
framed, introduced and pushed to its
passage by Senator Summer, of Massa
chusetts. A very small minority of
the Republicans then in the United
States Senate opposed and voted
against the measure on constitutional
grounds. The late Senator Matt. II.
Carpenter, df Wisconsin, led the oppo
sition, and in an argument of great
eloquence and poVerj pointed out and
demonstrated the unconstitutionality
of the proposed hill. Carpenter pur
sued the sanitflinc of argument just a
few days ago adopted by the Supreme
Court.

that the present system, with modifica
tions, is the best that can he devised

1. All persons liable to road duty
shall be required to work the roads
six days and no more Oach year.
2. The road-working days through
out the State sliail be the first Ft iday
and Saturday in the months of April,
August and October, but the superin
tendent of highways may, for bad
weather or other sufficient cause, post
pone the time one week.
8. The road service may be com
muted by the payment of two dollars
into the county treasury at the time of
collecting the annual taxes.
4. On or before the loth of March
each year the county commissioners
shall give to the superintendent of
highways of highways of each roa’d
district a list of all who have com-
mnted road service in the respective
districts.
5. A superintendent, on finding that
he has not sufficient hands to perform
the necessary work, aha.I report the
fact t<> the county commissioners, who
may authorize him to hire additional
hands at the price usually paid to day
laborers. r<

Judges’of the Superior Court of Geor

concealed weapons. A few well di
rected large fines will break up nearly
anything. It is a rare thing now that,
you can hear of any one bc^ng fined
for carrying a pistol unless it is with
the colored population, who bavi been
taught that a pistol is ns essential as
health, wealth or happiness.” The re
sults, we are sorry to say, have been
quite different in this State. Honest
efforts have been and arc now being
made to faithfully enforce the pro
visions of the Act, but so far as we
have observed there has been no per
ceptible effects, and white and black
alike now SifYr'y concealed weapons of
all kinds, apparently without fear of
prosecution or conviction.

It is said that Judge Forakcr, the
rcceilt Republican candidate for Gov
ernor of Ohio, has a superstitious dread
of the ninth day of October. lie ex
pressed himself a few days' before’ the
election as confident of the result but
t 4 or the fact that it came off on tlie
ninth of October. On this day, when
a child, he fell from a walnut tree mid 1
broke bis shoulder blade; on the same
date, while a young maw, he lost $100
on three-card monte; on the ninth of
October, while iff the army,* he fell off
a-horse and had to go to die hospital

work.
7. Ho shall receive from the comity
commissioners all necessary imple
ments for working the mads and be
responsible for their safekeeping.
8. He shall report to the comity
commissioners all absentee* and all

deemed guilty of a misdemeanor; pro
viding, however, if the defaulter shall
before trial pay at the rate of one dol
lar a day for the time lost with costs
(if any) further proceedings shall
cease.
9. Each road overseer shall, on the

tain from the superintendent the imple
ments needed by his squad, giving
his receipt for the same, and shall re
turn the implements on the Mdndsy
following.
10. Each squad of road Workers
shall assemble at the central point of
the respective road sections (4f no

August and October of each year.
11. The superintendent of highways

or any other infamous crime, instead
of living sent to the jienitentiary or
confined in idleness at the public ex
pense in the county jail,'as at present^
should be put at bard labor upon the
highways under the control of the
conntv commissioners. By this means
the roads for five miles aroiftid the
courthouse towns might be ihiftad-
amized in a few years.
