Ohio jobilanf, and reports all the
Democrats in that State as wearinsr

inting about the causes of their defeat.
He says: “Some of them attribute it
to the liquor law, seme to the clair-
vo*- ant medium tax, and still others to
the tariff legislation of the last Con
gress.” Mr. Cox chums that they are
all wrong and thinks the Democratic
victory is attributable to his own
efforts iu the canvass. The New York

Democratic gains were mostly in

The News and Courier jives a
synopsis, with some sound and excel
lent comments, of a paper recently
read before the American Social
Science Association, at Saratoga, by
Professor Francis Wayland, on the
subject of the “Death Penalty.” Prof
Wayland argues forcibly for its aboli
tion, and the points made arc well
worthy of attentive and impartial con
sideration at the hands of tiiosc who
justify its continuance oii the score of
expediency. He says in the first place
that it increases verv considerably the
difficulty of procuring a conviction.
And in tho second place that statistics
will show that tho crimes for which
capital punishment is or has been in
flicted, are not decreased oi’ diminish
ed in number by reason of the fact
that the death penalty is attached to
them. He shows negatively that its
abolition lias in no instance been fol
lowed by an increase of crime.
The Doctor proposes the substitu
tion of life imprisonment for capital
punishment without hope of pardon or
release by executive clemency. Of it the
News and Courier says: “If any re-
vi&ion of the sentcnfcc should be possi
ble, it ought to be by means of a sol
emn proceeding in the same court by
which sentenen was passed. It would
be easy by legislative action to pro
vide a method by which (lie ciruim
stances justifying a remission of the
life sentence should be reviewed by the
court and a modification of that sen
tence; or, if the case justify it, the
prisoner’s release. But the proceed
ings should be as solemn and as formal
as the original one.”
The practical force of Dr. Way-
land’s first argument setting forth the
serious difficulties in the way of secur
ing a conviction, where the punish
ment is death, is certainly in view of
our own experience and observation,

these unfortunates are unwilling to
flaunt to the world, through the courts
and columns of newspapers, tho dis
grace and ruin of those so nearly and
dearly related, but rather try ti con
ceal from the world their misfortune
and spend their days in vain efforts
endeavoring to reform these devotees
who have poured in the silent midnight
hours deep am! damning libations at
the shrine of the god of wine. This
they know and take advantage of; they
feel secure iu their iniquitous practice,
dealing out the poison th!U saps the
fountain of youth and health, degrad
ing the image of (Jod himself to the
level of beasts. Thus we see there is
no hope from this law. Let us, thou,
turn to tho other, that which with
wisdom strikes at the root of the evil.

verdicts of “guilty”, though tho law
and the evidence might justify none
other. Trembling with the awful re
sponsibility of deciding between the
issues of life and death, whimsical and
cowardly doubts are seized upon to
justify tho verdicts and smother the
elumowings of unen«y consciences, and
guilty felons are thereby turned loose
upon the country, to mix and mingle
with tiie good and innocent, and pur-
chancc to commit anew the dark, foul
crimes of the past. These are the real
facts in the history of criminal juris
prudence 111 over the land, and they
are in themselves ponderous arguments
against the expediency Mid efficacy of
the death penalty as a deterrent of
crime.
Tho great Italian Bcccnria once said:
“That crimes are more effectually sui»-
pressed by the certainty rather than
by the severity of punishment.” Affix
to the infractions of onr penal laws
punishments more in keeping with tho
instincts of humanity, and jurors will
vote oftener for conviction, and the
penalties of violated law will follow
certainly End swiftly upon the heels of
the offender. In other words, decrease
the quantum of punishment and in
crease tho certainty of its infliction,
and criminals with but litth? hope of
escape will pause, and pause long, be
fore they steep their hands in hutuau
blood.
Bid can wo no (/safely go farther and
say with Dr. Wayland that it is not
more effectual as a preventive of crime
than other and milder forms of punish
ments. In the days of Blackstono the
English law punished petit larceny
with death, and it cannot be shown
that the crime iu question was then of
Jess frequency than under the milder
and more beneficent penal laws of the
nineteenth century.
Under the laws of South Carolina
the crimes of murder, rape and arson
are now punishable with dea'th, and it
is a fact most generally deplored that
these very crimes are really, or at
least apparently, on tho increase in the
State. All the newspapers are daily
and weekly crowded with sensational
accounts of harrowing and blood
curdling murders in one portion of tho
State, entrageons rapCfrin another, and
midnight incendiary fires here, there
and everywhere. ’
A law “that knows no tfiiipcy” is
supplemented too by wliat the mobs
caH “the higher law”, and still the
deluging tide of crime rolls on. Sbonld
we not pause and seriously question if
Ire are not going headlong in the
Messrs. Editors, wo known there are
considerations of no little moment witli
many in this age when the qucstluii of
dollars and cents enters so largely into
tho computation of success. Let us
therefore turn with regret, for it is
with regret that we are compelled to
turn aside, from appealing to the higher
and nobler passions that arc implanted
in the breast of man to cajole ami
inveigle to lire baser desires for gain,
but this is the case. Can the town
afford to do awav with the granting of

If tho revenues of the town are insuf
ficient to carry oit tho Work necessary
with the present levy of taxes lot more
bo raised by extra taxation. Who
would begrudge tho smaB pittance of
a few mills more on the dollar, which
would only bo required tor a tow
years at most? This would only bd a'
temporary evil which is forgotten as
soon as removed, leaving no lusting
effect except for good; whilst that
which it would eradicate leaves a per
manent blight upon those who lintfe
felt its contaminating influence. Some
again would say, “If tho town was
only out of debt ! would vote for pro
hibition.” This appears to be con
vincing to their minds, but these very
ores will, without compunction, attend
meetings and vote an appropriation to
buy a $t,000 engine or build a new
road, not because the to require no new
debts, curtailing of expenses or extra
taxation, but because its returns earn
be valued in hard cash, or possibly'
they are of higher importance than
saving the future men of this couiriih-
nity from becoming drunkards. We
mean not to arraign tiie action of the
citizens fordoing this mei itorious Work;
which is of such advantage to the pub
lic and reflects so much credit upon our
town,- but only to show what efforts
can be made to* remove an evil that is
an eyesore to every one and in which
every ono takes an interest alike, for
all are in an equal degree concerned,
while that which is covered as it Were
by tiie cloak of secresy, and only sfeen
at times, and then by the few (yet all
know of it), is passed unheeded and
left to do its infernal work in silence,-
dealing its d£adly blows like tire cow
ardly hand of the assassin at the very
vitals of society, heaping in ohe indii-
criminhte mass the innocent and gnihy.
