VERDICT NOT GUILTY WAS
RETURNED YESTERDAY
AFTERNOON
JURY STAYED OUT
1 HOUR 6 MINUTES
Arguments Were Made Yesterday
Morning Followed By Judge
Moore's Charge to Jury.
Alter a deliberation of ono hour and
six minutos tho Jury yesterday after
noon at ;i:H5 returned a verdict of ucl
guilty in the case of Feaster Jone's,
iC.arged with killing Dr. L .0. Mc
Calla. N
Tho court room was crowded al
most as much as it was on Thursday
durlug tho trial, hundreds of peopli
anxiously awaiting the verdict.
As soon as the jury fl lcd in and
had taken their Beats, Judge .Mooro
warned the audience against any de- '
monstration. Mr. Jas. N. Poarman,
clerk of court, then called tho roll
or tho Jury and J. E. Garvin, fore
man. stated tout a verdict had been
reached.
When tho verdict was read, Mr. '
Jones iecolved it with a smile. Coun- ,
?el and friends seated nearby ox- .
tended congratulations, and court j
asked. Mr. Jones' council to prepare
the discharge order. After this was
dono and the order was signed. Mr.
Jones walked o;it of the court room. |
Everything .passed off quietly in tho
court room and there was no demon
stration .
The case went Into too hands of tho
Jury yesterday afternoon at 1:40
cj'clcck, ofter arguments by state's
attorney's and defense and after Judge i
Mooro had charged the Jury.
The first argument was mado by ?
Mr. Proctor A. Bonham for the j
state, who emphasised the actual fa?ts
of tho killing of Dr. McCalla and ,
who gave a possiblo motivo for tho j
slaying.
Mir. T. Frank Watkins mado too
first argument for the defense. He
charged assistant's stato's counsel os
bein g unconcerned tn the caso ex- '
copt for tho revengo of some out- '
sido party. This was followed by a
very urgont appeal for the life of his '
client.
Mr. Watkins was followed by Gen..'
M. L. Bonham for tho defense. Ho
made n very strong appeal for the
lifo of Mr. Jones and very vividly
depicted how a happy homo, 'iad been 1
broken np. His speech was rather
touching at (times and no ono could
bav? heard lt without' being affected
to some extent. . " |
} Mr. K. P. Smith, solicitor, closed
the case for tho state. The frond
o? ?ls argument waa to* show that
Feasterv Jones' not tcmporarllly . in-,
sano the morning that ho killed Dr. 1
McCalla. Mr. Smith waa at his ?est
and his argument wa."- splendid. :
Judgo Moore's cha ?'.<o to tho Jury
was not very lengthy. Tim attor1
noys tor the defense had requested
that toe jury bo ?harge-1 as to tho!
plea of temporary insanity, and ?ho
roquest of. the stjate was "practically

THREE NEGROES ARE ACCUS
ED OF KILLING ANOTHER
-SOME MYSTERY
WAS SADLY BURNED
And it is Not Known Whether
These Were Mods Before
or After Death Came.
Yesterday afternoon after ttio Jones
case was sent to tho Jury, another
murder case began to occupy tho at
tention of th? court. It was thai of
Charlie Donaldson, Trueman Davis
and Lawrenco Cowan, charged with
killing another negro in the Five
Forks section about tho Ilrst week in
October.
Shortly after tfvis case was begun
all Jurors and witnesses except those
engaged in it were excua&d, the jurors
for this term; and tito r. itnes3e3 until
Monday morning. It ia thought that
tho docket, will be cleared by Wed
nesday night.
When court took a recesB yesterday
afternoon, oil witnesses for tho state
In tito murder cr.3o had been on tho
stand, and tho defense had put up
two. Solicitor Smith represents -the
Btato and Breafceale and Pearman the
defense.
After the examination of the state's
witnesses, the defense askod that tho
court direct a verdict of not guilty
na to Trueman Davis and Lawrenco
Cowan, it appearing that there was
rio evidence to" convict tftom. The
state thought that there was testi:
mony that 'would implicate Trueman
Davis. AK ? result of the difference
in opinion byer the evidence, tho court
asked that tho testimony of Jim Wake-,
field ho road;iby tho court steno
grapher. A?ter/ltois waa done. Judge
Moore direct??;t? verdict of <not guil
ty -aa to Lawrence Cowan.
Tito killing took placo early ono
pluming ut a Baw mill. From tho
testimony it appears that George
Whitman, the deceased, Charlie Don
aldson and.'Trueman Davis - were
scuffling arouud'tho engine over a
gun. The glin-was discharged elf ter
accidentally erlern purpose. It later
developed that George Whitman waa
torrlbly burned about; tho body.
.In order to provo whether; these
burns wore made -before the negro
was killed or afterwards. Dr. H; H.
Karris will take the stand this morn
ing to gltt> expert/ testimony na to
burns nu.de before arid after death.
