Pender, who died last May at Cohen's Bluff, leaving an estate, the value of which is estimated at about $30,000. This case' was appealed from a de cree of Special Probate Judge for Allendale County, owing to tho dis qualification of J. E. Tobin, the regu lar probate judge.. Judge Hiers sus tained the will and admitted it to probate in solemn form. The issues submitted to the jury at the court of common pleas in volved the question of whether the will L. S. Pender, sf d if so, wag he at the time of the execution mentally capaci tated to execute the will, or was his signature procured by fraud or undue influence, holding that there waa no evidence to go to the jury on this point. The remaining issues as to the actual signing of the will and the question of mental capacity and fraud were submitted to the jury.
