mm A PROCLAMATION. By the President of the U. 8. of America. Wherea*, the 4th seetion of the 4th ar ticle of the CoD8titution of the United States declares that the United States shall guarantee t) every State in the Un ion a republican form of government, and shall protect each of them against invasion and domestic violence; and, whereas, the President of the United States is, by the Constitution, made Coiumandar-in-Chief of the army and navy, as well as chief civ il executive officer of the United States, and is bound by solemn oath faithfully to execute the office of President of the Uni ted States, and to take care that the laws be faithfully executed ; and, whereas, the rebellion which has been waged by a por tion of the people of the United States a- gainst the properly constituted authorities of the Government thereof, in the most violent and revolting form, but whose or ganized and armed forces have now been almost entirely overcome, has, in its revo lutionary progress, deprived the people of the State of South Carolina of all civil government; and, whereas, it becomes necessary and proper to carry out and en force tha obligations of the United States to the people of South (Carolina in secu ring them in the enjoyment of a republi can form of government.: Now, therefore, in obedience to the high and solemn duties imposed upon me by the Constitution of the United States, oud for the purpose of enabliug the loyal people of said State to organize a State Government, whereby justice may be es tablished, domestic tranquility insured, and loyal citizens protected in all their rights of life, liberty and property. I, Av* drew Johnson, President of the United States, and commander-in-chief of the ar my and navy of the United States, do hereby appoint Benjamin F. Perry, of South Carolina, Provisional Governor of the State of South Carolina, whose duty it shall be, at the earliest practicable pe riod, to prescribe such rules and regula tions as may be necessary and proper lor convening a Convention, composed of del egates to be chospn by that portion of the people of said State who are loyal to the United States, and no others, for the pur pose of altering or amending the Constitu tion thereof; and with authority to exer cise, within the limits of said State, all the powers necessary and proper to enable such loyal people of the State of South Carolina to restore said State to its Con stitutional relations to the Federal Gov ernment, and to present such a Rcpubli can form of State Government as will en title the State to the guarantee of the L nited States therefor, and its people to { irotection by the United States against nvasion, insurrection, and domestic vio lence ; provided that, in any election that may hereafter bo held for choosing dele gates to any State Convention as aforesaid, no person shall be qualified as an elector, or shall be eligible as a member of such Convdhtion, unless he shall have previ ously taken and subscribed the oath of amnesty, as set forth in the President’s proclamation of 31 ay 29th, A. D. 1865, and is a voter qualified as piescribe'd by the Constitution and. laws of the State of South Carolina in force immediately be fore the seventeenth (17) day of Novem ber, A. D. 1860. the date of the so-called Ordinance of Secession ; and the said Convention, when convened, or the Leg islature that may be thereafter assembled, will prescribe the qualification of electors, and the eligibility of persons to hold of fice un ler the Constitution and laws of the State, a power the people of the sev eral States composing the Federal Union have rightfully exercised from the origin of the Government to the present time. The person using or affixing the stamp or stamps, shi'll write thereupon the initials of his name and the date upon wliich the same shall be attached or used, so that the same shall not be used again, under a penalty of $60; or they may be canceled by such other method as the Commissioner of Internal Revenue may pre scribe. Documents mads in any foreign country, to be used in the United Elates, shall pay the same duty as when made here. •> Powers of Attorney, or other papers rela ting to applications for bounties, anearages of pay, or pensions, require no stamp; neither do indorsement o! negotiable instrument, nor any warrant of attorney accompanying a bond or note when such bond or note shall be stamped; and whenever any bond or note shall be secu red by mortgage, but one stamp duty is requi red, provided the stamp duty placed thereon' is the highest rate required for said instru ment, or either of them. All willful neglect to comply with the con ditions of these Stamp Duties will be punished as the law directs. A PROCLAMATION. All who resigned of tendered the resignations of their commissions in the army or navy of the United Stale-, to evade duly in resisting the rebellion. Sixth. All who iiave engaged iu any way in treating othuwisc than lawfully as prisoners of war, persons found in the United Surtes service as officers, soldiers, teamen or in other capacities. Seventh. All • arsons who have been or are absentees lima the United States, for the purpose of aiding the rebellion. Lighth. Ali military and naval officers in the rebel service, who were educated by the Government in the Military Academy at West Point or the U. S. Naval Acad emy. Ninth. All persons who held the pre tended efficc ol Governors of States in in surrection against the United States. Tenth. Alt persons who icit their homes within the jurisdiction and protection of the United States, and passed beyond the Federal military line into the so-called Confederate States, lor the purpose of aid ing the rebellion. Eleventh All persons who have been enga 0 ed in the destruction of the com- nusice of the United States, upon the high seas, and ail persons who have made raids into the United States, from Canada, or been engaged in destroying the commerce of the United States, upon the lakes ud rivers tha operates the British Provinces from the United States. Twelfth. All persons who arc ^at the time when they seek to obtain the benefit hereol by taking the oatii herein prescri bed are iu the m litary, u.ivul or civil cus tody, or are under bonds to the civil, mil itary or naval authorities of the United States, as prisoneis of War, or persons de tained for any offenses of any kind, cither before or after conviction. ^— ThirUmuth. All persons who have vol untarily participated in en.id rebellion and the estimated value of whose taxable pro- jperty is over twenty thousand dollars. Fourteenth. All persons who have ta- ; kcn the oath of amnesty as prescribed in ( thc President’s proclamation of Dec 18, r A. D. 1863, or another of allegiance to the government of the United States, since the date of said proclamation, and have not thenceforward kept and maintained the same inviolate, provided that special application may be made to the President, for pardon by any person belonging io the excepted classes, and such clemency will be^ be rally extended as may be consistent wiui the faces af the case and the peace and dignity of the United States.
