The Court decided this requirement to be unconstitutional. They held that it was not necessary to the validity of writs and other prooess in judicial proceedings in the Courts of tho States, that the Internal Revenue Stamps prescribed by tlie Aot of Congress should be affixed to the writs or process , that the Government of the United Statss has not the constitutional powor to require "stamps to be affixed to a process issued by the State Courts. From that Institution he was discharged by a decision of Judge Nelson, of the Supreme Court of the United States, obtained in a suit for a writ 'of Habetu Corpus, which was granted. Returning home a few days since, he wus rearrested by the military authorities of this State, and confined in the jail of this city until his a present release, which is final and absolute. Chas.
